No charge for Texas dad who killed daughter's rapist

A US father who found his five-year-old daughter being raped, then beat the attacker to death will not be charged, prosecutors have said.

The 23-year-old man told police he found the girl being assaulted on Saturday 9 June by Jesus Mora Flores in a rural part of southern Texas.

A grand jury has declined to indict the man, finding that he was allowed to use deadly force to protect his daughter.

The father has not been named to protect the identity of his daughter.

The Lavaca County district attorney and sheriff announced the man would not face charges, as they held a news conference on Tuesday.

A guy in OC heard something at about 11 happening in his nine year olds bedroom. Turns out a loser was trying to abuse his daughter. They interview him the next night on the news, big dude, probably 250 lbs., mostly muscle. He calmly explains what happened and said he was able to capture the offender. The reporter ends the segment stating the offender is being held in the County Medical unit. Turns out the Dad catches the guy, picks him up and tosses him from the second floor to the first floor (wood floors) breaking the guys legs and pelvis.

There are some things that are so heinous that you have to excuse any action to stop those acts, including killing the perpetrator.

I don't think anything disgusts me more than sexual predators of children.

The father didn't just think the dead man was a molester, he literally caught him in the act. He caught the molester forcing himself on his daughter, with his pants around his ankles, and did what any father would do - punched the hell out of him. The dad got in a lucky shot, brained the molester and killed him. It probably happened so quick the father didn't know what he just did until after it was over.

In every state, defensive use of force is legal, and this father used what is usually non-lethal force - his fists. He just landed a freak blow that turned out to be lethal. And he landed that blow in a situation where his daughter was being sexually assaulted with violent force. Justifiable homicide.

Fists and feet are used in twice as many murders as rifles.

That said, even if the force was expressly intended to be lethal, his actions would still have been considered justifiable, as each state authorizes lethal force to interrupt a "forcible felony," the definition of which usually includes rape, sexual assault, or both.

Article I read said authorities said he was remorseful about teh death...that wasn't his intent.

Yes, hitting someone isn't usually fatal, but it happens, a lot more than most people think. You don't even need to intend to kill the target.
