This is some Weimar shit going on in NC, and it requires retaliation.
Biden can recognize the Senator from New York rather than the Senator from Kentucky when their session opens, before they swear in the new class.
At that moment, Democrats will have a majority.
I dismissed this as fanciful a week ago, but the North Carolina coup d'etat is a declaration of war.
34 Senators make a quorum, and the Democrats will have the majority at that point.

(113,131 posts)GOP made it a focus to undermine Obama and Dems in 2009 not just through obstruction, but by fighting like hell for every seat in the country that came up, especially Ted Kennedy's seat. It brushed the Dems back straight through to the 2010 election.

(61,753 posts)It's becoming starkly clear that Republicans lie, cheat and steal and half of America cheers. Apparently, 50% of us - give or take the margin Hillary won the popular vote by - are willfully stupid morans who want abusive leaders. Half the country wants a dictator because apparently they're so scared of immigrants and black people (but apparently not the Russians anymore) they will sacrifice any freedom, any shred of decency, to put the Strong Man in power.
Democrats only hope is to show that we are ruthless too. Time to fight back in any and all possible ways. At this point what do we have to lose.
We'd pick up some moran votes.

(5,586 posts)Trump could theoretically appoint as many judges to the court as he wants, provided the Repubs in congress went along with it.
If we tried to appoint Garland like this and succeeded, I have no doubt the Repubs would see around this limitation of the court to 9 justices.
FDR tried to appoint more judges to the court when they ruled against several of his New Deal policies, but ultimately his party didn't back him.
