Should what's on your Facebook page be a factor in determining whether you're allowed to re-enter the United States? That's a question to ponder in the wake of President Donald Trump's ban on immigration that began on Friday.

Border patrol agents are checking the Facebook accounts of people who are being held in limbo for approval to enter the US, according to a Saturday tweet by immigration lawyer Mana Yegani that was spotted by The Independent.

"US border patrol is deciding re-entry for green card holders on a case by case basis -- questions about political views, checking Facebook, etc," Yegani's tweet writes.

The ban currently applies to immigrants from seven countries, leading tech executives from almost every major company -- including Apple, Google, Facebook and Netflix -- to decry the move as "un-American."

Yegani, who is a member of the American Immigration Lawyers Association, told CNET that checking phones has been reported by other lawyers as part of the vetting process.

"The CBP going through passengers phones from the seven banned countries happens when the individual is interrogated (put under extreme vetting)," Yegani said.

Incidentally, that's in line with a warning from the Electronic Frontier Foundation that in general, anyone can have their phone checked while at the border.

I think the ban is bad, but, if you're going to do it, do it right.

Checking Facebook accounts (public privacy) is proper due diligence when looking for extremism.

Again, I'm anti ban, but this seems like common sense. Many of the terrorists used Facebook as extremism before committing their acts. This includes domestic terrorism, not even related to Islam, such as Dylan Roof..

I suspect it will be used to deny entry to people and families of people who simply think Mr. Trump is a waste of skin, which would, by that measure make me and most of DU "terrorists."

But that's not a reason you shouldn't check.

People could be denied because they dislike Trump, but that hasn't happened yet. I think checking Facebook for extremist support is common sense.

1) You have no way of knowing that

because

2) They wouldn't make that public

and

3) Facebook is full of fake profiles from sexy young Thai virgins and people who "made $3000 last month working from home".

It's as reliable a way of knowing whether someone is an extremist as knowing how good a shot with a pistol an online gamer is by looking at their Call of Duty Xbox achievements. As in, not one bit.

I've watched a couple of the 'border patrol' reality shows on Netflix (Australia and Canada, there's a US one that I haven't watched yet) and the Customs and Border Patrol officials will frequently check someone's phone, emails, etc to see if they're telling the truth (for example, trying to stop someone from working on a tourist visa).

If you post shit on social media and tell officials something else, you will get caught (same with other things).

The fact that they have misidentified who is in charge is a clue that this is, at best, an unsubstantiated rumor.

CBP officers are not Border Patrol Agents. Border Patrol Agents don't have authority at ports, Customs Officers operate at the ports. They are not trained for the kind of investigation that they are describing. If a Customs Officer (who is trained for high volume checking of documents and drugs) find something unusual they would call a DHS ICE agent to investigate. Customs Officers do not need a college education and are trained to go through hundreds of people passing through a port an hour.

Agents follow standard operating procedures and deviating from them would open them up to disciplinary charges and possible loss of job. While Trump has talked about adding this kind of investigation in the future I don't believe that agents are embarking on this without detailed written policy, which hasn't happened.
