While judges will often defer to the legislative branch on issues where they have been asked to change rather than interpret a law, they'll go all Marbury v. Madison when another branch tries to blow them off. They also happen to be real people, and I'm sure there's not a judge in the country who didn't bristle a bit when Trump referred to Judge Robart as a "so-called" judge. Trump's attitude that the judiciary are somehow illegitimate is bound to affect other judges' (including the Supreme Court's) attitudes toward him and his administration no matter how hard they try to be objective.

(15,412 posts)It was a Utah Federal Judge who first found the law against gay marriage unconstitutional. And remember the courts gave us separate is NOT equal and abortion and birth control to name just a few.
