that is, the 3 have voted, they're likely drafting a decision.
But COULD be thinking about referring to the entire court, 'en banc,' and COULD be trying to address the important/serious procedural issue: Should they refer it back to trial court on the issue of 'mandamus.' Lots of possibilities!

I wouldn't be surprised if they didn't take several days to write the opinion. In a normal course-that might go on for a month-but this is an expedited matter so I'm sure they will try to get it out quickly.
