I sure hope that when this goes to SCOTUS that Kennedy sides with the moderate/liberals, otherwise things will be totally fucked with 2 courts and 2 decisions.

(4,558 posts)Generally, federal overreach cases are JUST the kind of cases that Justice Kennedy crosses over on most of the time.
It's even possible that Justice Roberts would cross the line, especially after 45's verbal attacks on the judicial branch.

(4,558 posts)With the current SCOTUS numbering 8, I think a 4-4 split is the BEST case that #45 could possibly hope for. Not a chance that Justices Ginsburg, Sotomayor, Breyer, or Kegan would decide to uphold the decision.
Kennedy has long been the wild card, and this is just the kind of federal overreach type of case he's famous for crossing over on.
Justice Roberts has at least a fair chance of crossing over and deciding in our favor. He's been fairly good about maintaining the decisions of the lower courts.
Alito and Thomas have a tendency to align their decisions with conservative causes, but in this case, especially with #45's criticism of the court, it's actually possible that the SCOTUS to give a unanimous decision to uphold the lower court decision..
Damn that would be a SWEEEEEEEEET result.

However, on a sober note, it appears from things seen on the 'Net that some agencies are upholding the ban anyway. Makes no difference how the courts rule if the criminals won't follow the ruling.

(10,272 posts)Alito and Thomas for the dissent, sure, but Breyer should come down with the liberals on one (I would think) and that leaves Roberts. If he's feeling like the president is ignoring the court as a co-equal Branch, he will side with the liberals just to let the executive know he probably shouldn't be fucked with in his own house. I think this could be a nice test to see how much rope the executive will be extended by the Chief, but if they piss him off I think Roberts will have no problem jerking that leash a little.=)
I don't think it will be a tie, that's if the court even takes it to hear. A 3-0 decision is pretty airtight already...I would think the only reason to take it would be to closely examine an argument to overrurn, and that seems unlikley

(4,558 posts)I think a 4-4 split is about the worst we would face. I wouldn't even completely rule out Alito and Thomas making it a unanimous decision to uphold the lower court ruling in this particular case. That'd be a longer shot, but daaaaamn that would be sweeeeeet.
