AZ lawmakers want to seize the assets of protesters.

Claiming people are being paid to riot, Republican state senators voted Wednesday to give police new power to arrest anyone who is involved in a peaceful demonstration that may turn bad — even before anything actually happened.

SB1142 expands the state’s racketeering laws, now aimed at organized crime, to also include rioting. And it redefines what constitutes rioting to include actions that result in damage to the property of others.

But the real heart of the legislation is what Democrats say is the guilt by association — and giving the government the right to criminally prosecute and seize the assets of everyone who planned a protest and everyone who participated. And what’s worse, said Sen. Steve Farley, D-Tucson, is that the person who may have broken a window, triggering the claim there was a riot, might actually not be a member of the group but someone from the other side.

But Sen. John Kavanagh, R-Fountain Hills, said that chilling effect is aimed at a very specific group of protesters.

“You now have a situation where you have full-time, almost professional agent-provocateurs that attempt to create public disorder,’’ he said.

“A lot of them are ideologues, some of them are anarchists,’’ Kavanagh continued. “But this stuff is all planned.’’
There’s something else: By including rioting in racketeering laws, it actually permits police to arrest those who are planning events. And Kavanagh, a former police officer, said if there are organized groups, “I should certainly hope that our law enforcement people have some undercover people there.’’

“Wouldn’t you rather stop a riot before it starts?’’ Kavanagh asked colleagues during debate. “Do you really want to wait until people are injuring each other, throwing Molotov cocktails, picking up barricades and smashing them through businesses in downtown Phoenix?’’

Check out the logo above the rear wheels of the bus. Would Kavanagh's unconstitutional bill punish these folks, as well? If not, why not?

Good luck with this state lawmakers. You're about to meet the judicial branch up close and in person - not unlike Trump recently did - if this passes.

Pro tip: just because you're called a "lawmaker" doesn't mean you're above the law. You are not gods, and you still have checks and balances, not to mention constituents to answer to.

Now, grow up and actually focus on things your state needs, m'kay?

You can protest on private property permit free. Cities require permits for public areas because they have to adjust traffic or close off other public areas from use by others. An example is the permit will allow a park to be used by separate groups at different times for events like weddings, birthdays, or protests.

The right to assembly protects the right of free association and allows groups to meet for worship, discussion, politics, hobbies, etc without government interference. Normally, thus done permit free as these are done in private spaces or with permission of a landowner. An example is a scout troop meeting in a church because the church allows them access. A birthday in a backyard or party is another example.

It's not an equal comparison. There is no right to block a city street without prior agreement from the city. The permits are not a restriction on the right of free assembly; free assembly is the right for groups of people to congregate without the government interfering in non-public spaces. It comes out of restrictions that were imposed to stop people meeting up in bars and churches, etc to discuss ideas that the government didn't want them to express, like independence from the empire.

I think the strongest thing I saw at our local women's march was filtered water in a stainless steel eco thermos.

Now those donuts that people are bringing to protests, gotta watch out for those!

and if it fails in the lower courts they usually hope for it to be kicked up to the Supreme Court, which will end up being conservative. Just like with anti-abortion laws, it this fails in the courts some other state will come up with similar legislation.
