Hillary was not. Different laws apply regarding disclosure.

There is also a lot we don't know yet about this whole situation - especially about peoples' motives. From watching Comey at this morning's hearing, he struck me as a very straight shooter. If that is true, it means there's something very big that we don't know about that event.
