And force Republicans to agree to pro-forma sessions.

Both the House and Senate must agree before they can recess.

As I recall, McConnell started doing did this sometime in 2010 before Republicans took the House, to thwart Obama recess appointments.

mcturtle may not go nuclear but there's nothing to stop him from a recess . Congress decides when it is in recess

To remain in effect, a recess appointment must be approved by the Senate by the end of the next session of Congress, or the position becomes vacant again; in current practice this means that a recess appointment must be approved by roughly the end of the next calendar year. Recess appointments are authorized by Article II, Section 2 of the U.S. Constitution, which states:


The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.

I suspect that he would withdraw. You would probably get someone a lot less likely to pass a confirmation, maybe Melania for example.
