Is Trump Trying to Lose?
Three ways Mondays bizarre tweetstorm sabotages his administrations defense of the travel ban.

While there are several layers to Trumps self-sabotage, the one closest to the surface is the most significant. As the 4th Circuit explained in its recent decision, courts must generally defer to the federal governments determinations regarding immigration and national security. There is, however, a key exception to this rule: When a plaintiff makes an affirmative showing of bad faith that is plausibly alleged with sufficient particularity, courts can look behind the action to search for constitutional infirmities.

For months, Trumps lawyers have insisted there is no such evidence of bad faith with regard to the travel ban. On Monday, Trump burned that argument to the ground.
People, the lawyers and the courts can call it whatever they want, Trump tweeted, but I am calling it what we need and what it is, a TRAVEL BAN! Later, he reiterated his belief that we need a TRAVEL BAN for certain DANGEROUS countries, not some politically correct term that wont help us protect our people! At a bare minimum, these statements imply that the lawyers are not telling the truth about the order, propping it up in politically correct pretext to shift the focus away from certain DANGEROUS countries (that happen to be Muslim-majority). The tweets run counter to the DOJs arguments and hint at a more malign motive. In short, they illustrate precisely the kind of bad faith necessary to look beyond the orders text to determine its true intent.
Thats bad news for Trump, because once courts are able to examine his statements for unlawful animus, theyll find loads of it. Now, it is true that Trump made his most vicious anti-Muslim statements before entering the Oval Office and that his second ban omits unambiguous references to religion. And under relevant Establishment Clause precedent, prior indications of illegitimate purpose do not forever taint a state actor. The taint of unconstitutionality can dissipate, and Trumps defenders assert that the presidents conciliatory statements about Islam may have done the trick.
Yet Mondays tweets might as well have been designed to perpetuate the stain of animus that Trumps lawyers are working so very hard to bleach out. Trump reverted to his instincts, railing against the politically correct second ban, grousing that the Justice Department should have stayed with the original Travel Ban, and claiming that his administration might seek a much tougher version! An extremely generous reading of these tweets could still not overlook the implication that the second order is, to Trumps mind, simply a less effectual version of the initial ban, and that neither of the orders accomplished his true goal (hence the need for a much tougher version.) And what is that goal? Before becoming president, Trump stated it outright: a total and complete shutdown of Muslims entering the United States. His tweets on Monday suggest that this unconstitutional objective still lies behind his executive orders.

So, what in the world is Trump doing? Is he crazy like a fox, gaming this litigation in some fashion that we dont yet understand? Is he so irked with his lawyers that hes simply trying to foil them in court?
We think the explanation is simpler. Trump isnt gaming anything. Hes simply acting from his usual place of id, pride, and cluelessness. That doesnt mean hes destined to lose: Wed say he still has roughly a 50-50 chance of winning at the Supreme Court. But his tweets are making it increasingly difficult for his lawyersand his allies on the benchto give him cover. Trump isnt crazy like a fox, and he isnt trying to lose. He just doesnt understand how to win.

(10,252 posts)Lacking self control, unable to tame his negative emotions of anger, frustration, he lashes out without thinking out the consequences or seeking advice. He has been warned by staff not to tweet. He has seen the reaction that people have to his tweets, yet he has learned nothing and continues as before. Because from his view, he is always right, and anyone who opposes him is wrong. Stupidity is the inability to learn.

(16,245 posts)The Trump Administration may well ignore it. People will sue, of course, and win, but are Customs officials really going to go against Trump? I guess that's the million dollar question in my mind- just who is going to make Trump obey the law on this or anything else?

He's an addict who is constantly in need of instant gratification from adoring crowds, his sycophantic acolytes, or the fan fiction churned out by the rightwing media. His entire world consists of lies, and be believes them all.
He reacts childishly and impulsively based on his emotional response at the time. He is vindictive and lashes out like a wounded animal, biting and clawing at every perceived sight, no matter how inconsequential. He has given no thought for tomorrow or the consequences that follow him. He has no dearly held plans or policies, no original ideas, and no goal to accomplish anything beyond his next tweet.

(3,334 posts)I think he really believes himself to be a King of sorts. Look at everything he has already done, unchecked. He believes himself invincible and untouchable. He is doing anything that he wants, because he has been able to do anything that he wants.

Ego reduction is good for the soul, but it hurts like hell and is very embarrassing in the process. Sometimes we have to let the Trumps of this world find out everything the hard way, because they will anyway.
