President Donald Trumps attorney intends to file a complaint with the Justice Department against former FBI director James Comey for his leak of a personal memo to a friend who then passed along the document to reporters.
That complaint, and the presidents Friday morning tweet griping about Comeys action, could be considered obstruction of justice, according to a legal expert who spoke to the Washington Post.
Stephen Kohn, a lawyer who specializes in whistleblower protection, dismissed the pending complaint by Trump attorney Marc Kasowitz as frivolous grandstanding because the Justice Departments inspector general no longer had any authority over Comey as a private citizen.

Initiating an investigation because you dont like somebodys testimony could be considered obstruction, Kohn told the newspaper, and in the whistleblower context, its both evidence of retaliation and, under some laws, could be an adverse retaliatory act itself.

(11,087 posts)It never occurs to him that if he calls it a leak instead of a lie, he implicitly admitted that it is true. Of course, a lot of things he denies are also true. And many things he insists are true, aren't. It's basically all about protecting his fragile, fragile ego.

(120 posts)and they became property of the FBI because of this. I heard some lawyer on Morning Joe talking about that. Trump is digging for anything he can to keep from being impeached. I hope there are tapes that will come out. Comey did a great job yesterday and even though I hate what he did to Clinton to help sway the election, the fact he is willing to face down this person that hijacked the presidency, I have a little more respect for him. Comey use to be a prosecutor, I don't think he would have leaked the notes if he knew he could be in trouble.

(959 posts)because they are useful in his private ventures. He is going at this like it's a private matter, threats, intimidate, shyster lawyers making ridiculous threats. He still doesn't realize that he is not hidden behind the curtain anymore; it's all visable, 24/7 on every channel, with millions and millions of eyes on all of them. He's an old man, using the tactics he learned 50 years ago, in a world that he doesn't have a clue about. This will end badly for all concerned.

(5,811 posts)would make a rookie mistake of releasing his memoes if he could be charged with a crime. It's not like he could make the claim to be new at his job and therefore should be forgiven for mistakes. But Mr. Comey was a seasoned veteran from his position with the FBI, in addition to being an attorney, so I think he more than likely had an idea of what he was allowed to do and especially what he would not be allowed to do.
I think tRump and his attorney are grasping at straws. tRump likes to sue people just to intimidate and aggravate anyone who crosses him. Comey did a whole lot more than cross him, so he has to hit back. (His words to describe what he does to deal with perceived hurt or harm.)
It is standard operating procedure for the thin skinned whiney-baby to retaliate against anyone who makes him angry.
I look forward to how this works out for tRump.
