(90,769 posts)What do people think African-Americans see when haters march with the confederate battle flag and assorted other white supremacist paraphernalia?
They see the incitement of the oppression of black people - the call for a return to the enslavement, lynching, torture, abuse, and rape of black people. The total control of black people. The ownership of black people.
What? People didn't know that's what the confederate battle flag represents?
Well, now they know.

(9,527 posts)Unless there is a specific and overt call to action that is directly linked, it's absolutely covered by the first amendment.
The cartoon is simply put wrong legally. Just because the cartoonist wants to claim that something is incitement doesn't actually make it so. This is basic law. Merely having a nazi flag doesn't even come close to meeting the criteria of the Brandenburg test.

(9,527 posts)This would get laughed out of court if somebody tried to claim that the mere presence of a nazi flag was enough to qualify for proactively punching the person with it. It doesn't even remotely come close to passing the incitement test.
If you'd like to understand how utter silly this is, try swapping the flag for a U.S. flag and talking about the genocides on Native American tribes and how that means if you have a U.S. flag a Native American would be justified in punching you.
