How does Trump's new 45/USA hat not directly violate the Emoluments Clause?

Argue what you want about his other scams, but this is as blatant as it gets. He's selling cheap-ass Chinese-made "45" logo hats on his web site for $40. How is this the slightest bit legal?

i vaguely recall stories about then-vice president al gore needing to go across the street at some point to make a fund-raising phone call because doing that on government property was a no-no.

but of course, none of this applies to republicans....

They don't seem to understand that it is still in violation of our Constitution?

That is one ugly shape of a hat. It looks weird. Granted I've never been a fan of trucker hats but his is extra sad.
