Nashville woman shot homeless man who asked her to move her Porsche then left him to die: police
A 26-year-old Tennessee woman has been arrested after she shot a homeless man who asked her to move her Porsche, Nashville metro detectives allege.
The Tennessean reports that 54-year-old homeless man Gerald Melton was critically injured this week when he was shot twice by Katie Quackenbush, who was driving a Porsche SUV near the area where he was trying to sleep.
Police say Melton asked Quackenbush to move the SUV because its exhaust fumes and loud music were impairing his ability to sleep. The two then got into a loud argument with each other, and then Quackenbush allegedly exited the vehicle holding a gun that she then used to shoot Melton twice, leaving him with a wounded abdomen.
Police say Quackenbush then got back into her car and fled the scene.
Quackenbushs father, Texas attorney Jesse Quackenbush, defended his daughter after her arrest by claiming that the homeless man was threatening to kill her shortly before she decided to get out of the car and fire her weapon at him.
She didnt try and kill this guy, he said. She had no intention of killing him. She didnt know that she hit him She did say she closed her eyes when she shot both times, but they were warnings, and she thought she pointed away from him.

(16,869 posts)You're telling me this sweet sweet girl just fired a couple warning shots and left the scene....without knowing she shot the guy??!! That smells of bullshit. Either she was under the influence and didn't realize or care that she shot this man or she ignored the fact the guy was screaming cause I'm pretty sure most people who are shot let out some kind of acknowledgement of the act, just saying.

(10,611 posts)All he had to do was get back in his car, and take the advice of 911 on top of it. He decided to escalate, committed murder, and got away with it.
Unfortunately there's a good chance that this would-be murderer can do the same with Daddy's help. But I hope either some modicum of justice - or karma - prevails.

but the poor frightened woman needed to exit the vehicle because she was afraid ...(that she wouldn't be able to shoot him at the angle from inside the vehicle)

(23,334 posts)a couple years ago where a 20-something guy leaving a strip club, got out of the safety of his vehicle and shot another 20-something guy who was verbally threatening him. Some witnesses say the man who was fatally shot reached into the window of the vehicle at some point. Regardless, the guy who did the shooting could have driven away at any point or locked his door and rolled up his windows...instead, he got out of his truck and pointed a gun at the guy who was talking trash and killed him. The shooter was notoriously a horrible person - all kinds of evidence illustrating what a jerk this guy is and at the end of it all...he was acquitted!!! This spoiled little brat probably will too. And, it's Texas.

If she intentionally shot him because he was threatening her (leaving aside the likelihood that a Porche can travel faster than a man can run) she may have a case for self-defense. She might even be excused for leaving the immediate area to go to a safe place and immediately call police.
The story of blindly firing in an attempt to scare him removes any self-defense claim. Instead it is reckless endangerment of the victim and any others in the area. As she failed to miss more charges of negligence can be added including attempted homicide.

I wonder what the difference in maximum and minimum penalties is.? And I bet it's easier for some judge to let her off for the light sentence on a reckless endangerment charge. She is, after all, white and blonde kind of.

(130 posts)If you're in fear for your life, you don't fire warning shots, you shoot to stop the threat. Daddy should know that explanation is going to go against her defense. Even if her money keeps her out of jail, that homeless man isn't going to be homeless much longer.

Daddy's argument doesn't hold water. She couldn't just drive that super fast, easily maneuverable race car away IF she was threatened? She had to first get out (and put herself at more risk than staying inside the car) and second had to shoot (with her eyes closed)???? Come on!

A 26-year-old aspiring country singer has been charged with attempted murder after police say she shot a homeless man twice near Nashvilles Music Row in August after he asked her to move her Porsche SUV because loud music and exhaust coming from it were disturbing his sleep.
The victim, 54-year-old Gerald Melton, was shot twice in the abdomen and remains hospitalized in critical condition, according to police. Investigators say Melton did not impede Quackenbushs ability to leave the area.
Katie Quackenbushs father, Jesse, says that his daughter, who is the single mother of a 5-year-old son, had no intention of shooting Melton.
She then fired two warning shots and left, her father said. There was no indication Melton had been shot, the suspects father said. Melton did not scream when hit, according to Jesse Quackenbush.
The elder Quackenbush told The Tennessean his daughter and her friend decided to leave and go to a restaurant, and come back later for the other womans car.

- She's only given $25,000 bond
- Her prior criminal history isn't broadcast in the media
- The local paper's article is packed with cutesy pictures of her and her son, notes that she's a single mom and gives much more space to her daddy's explanation than to the victim's version. The slant is impossible to ignore.
Now let's make Miss Quakenbush a little darker and less affluent:
- She'd be locked up with $250,000 bond or even no bond
- Every encounter with police would be in every news piece about her
- The article about the shooting would emphasize the victim's statement while making her look reckless and violent and it would feature her mugshot plus the most salacious photos possible of her drinking or smoking or in skimpy attire.
- They certainly wouldn't give column space to any explanatory statement by her father or anybody else unless they were criticizing her.
