It is an amendment.
It can be removed or modified. The idea it is written in stone is a fallacy.

(42,641 posts)But fro some on the right, the Second Amendment was written on the reverse side of the Ten Commandments.
Ask Roy Moore.

(39,171 posts)Right now gun ownership is an individual right not connected to militia service.

(33,432 posts)the Unorganized Militia needs the fuck regulated out of it.

(1,927 posts)From a legal standpoint at least. DC v Heller basically severed the militia clause from the Amendment. Arguing to tie the the right to own guns to militia service is a legal dead end at this point until Heller is overturned.

(21,506 posts)They may not be saying it in those words but they certainly act like it could not be abolished.
It can and I would argue at this point needs to be or at the very least heavily modified.

(13,874 posts)How in the hell would anyone think we could get 2/3 of Congress to pass a Constitutional Amendment to repeal the 2nd, and then have 3/4 of the states endorse it? Ridiculous.

(7,412 posts)There is a clearly defined procedure to do so. Any amendment could be modified or abolished with enough political support.

(18,585 posts)The bill of rights grants no rights, so repealing an amendment merely moves the right from being enumerated to unenumerated.

(22,976 posts)Guns are a $15 billion-a-year business, and the Republican Party and NRA are comfortable with that. It's mind-boggling that after incidents like Virginia Tech, Aurora, Sandy Hook and Las Vegas (to mention only a few), neither the Republicans nor the NRA feel the need to change anything. It's just business as usual...in the United States.
