*Ruth Bader Ginsburg, age 84, told NPRs Mark Sherman during an interview on Saturday that, while speculation has run rampant about her impending retirement due to her advanced age, she has absolutely no intention of stepping away any time soon. When asked the question she hears so often, Ginsburg was quick to respond.
My answer is as long as I can do the job full steam, I will do it
I used to have an answer, it worked for a lot of years. It was Justice Brandeis, when he was appointed he was the same age as I was, 60. And he stayed for 23 years, so I expect to stay at least as long. Well, now Ive passed Brandeis, Ive passed Frankfurter.'>>>

(34,857 posts)The Democrats held the Senate and the GOP would have not been able to successfully attack with the whole 'lame duck' thing. She made a mistake. Let's just hope Trump won't have to replace her.
mr_liberal
(1,017 posts)because it would just be a liberal for a liberal. They stopped Garland because it was Scalia's seat and would have tilted the balance and because it was an election year.
Drunken Irishman
(34,857 posts)I think the GOP would've done exactly what they ended up doing. It also would have been in their hands since they would've controlled the Senate. So, they could vote down anyone theoretically. And probably would have.

(1,017 posts)I still think Obama would have got someone confirmed for Ginsburg for the reasons I mentioned.
EDIT: Ill say this, Obama would have had to nominate someone very moderate maybe even a moderate republican. I just looked and it was a 10 seat gop majority so it would have been tough but I really doubt they'd filibuster for years to keep a democrat president from replacing Ginsburg.

(92,190 posts)nominee in 2016 did, this would not have been an issue
I remember discussing this, and being ridiculed when I said if for no other reason the Supreme Court should be the reason to vote for the Democratic nominee
Unless we can get control of the Senate, its over for decades to come
Hekate
(90,690 posts)One time I got so tired of articulating the bloody obvious regarding voting for the Democratic nominee (notably Barack Obama) that I started writing, simply: SCOTUS. SCOTUS. SCOTUS.
And then spent the next seven years hiding out in the BOG when he won.
still_one
(92,190 posts)would have been the solution to any Supreme Court vacancies under trump, it fails to recognize all the other variables that would have made that a non-issue, especially the primary one, electing Democrats
No surprise Hekate, we are on the same page

(6,974 posts)Agreed.
It's rumored that her daughter tried talking to her about stepping down during that last health scare she had a few years ago, but allegedly she'd have none of it. Their "discussions" caused a bit of friction between them "allegedly" at the time.
That courts gonna be SO far right for generations to come, it won't be funny. Fatso's also packing the lower courts like mad as well
unfortunately with right-winged wacko judges 😪😪

(6,278 posts)Clinton won by 3 million votes and in a sane world we would have held the Senate. Ginsburg was supposed to foresee the Trumpocalypse? Sure, looking back that makes sense, but there was no reason 3 or 4 years or so ago to imagine we'd be in this pickle today. And as we saw with Garland, she would have had to retire no later than 2015 (and really, who's to say they wouldn't have come up with even shittier excuses for not confirming an Obama nominee then

(12,051 posts)Republican would probably be elected. Historically, that's been the case. After an 8-yr run of one party, the other one has a great chance to win. So, early on in Obama's first term would have been a great time for judge retirements. He was riding on a wave of joy and Pubs would have been wary of his power then.

(37,648 posts)Assuming she lasts longer than Holmes, being female and born later, let's say she can go to 92. That's eight years.
But this isn't hindsight. I and many others have thought for years that she should retire, while a Democrat is in office, because her time on the court will be coming to an end with a few years, anyway, probably.

(50,949 posts)I think it was simply realistic then. Because of the situation we find ourselves in now.
Especially after the cancer scare. Although let's not forget what happened with Merrick Garland. She'd have to have known to do it in O's sixth year.

(37,648 posts)Let's face it. She has passed the life expectancy for a woman of her generation. She could pass on at any time, although I don't want that to happen. What is it that Justices like to stay until they keel over, clinging to their jobs until their last breath? OTOH I was sad to see Sandra Day O'Connor leave early for personal reasons. That's how we got Alito.

(14,308 posts)"as long as I can do the job full steam" ???
There's not an 84 year old in the world that can do their job full steam anymore, and she doesn't look like she's among the most fit 84 year olds. I agree she should have retired in 2015.
Drunken Irishman
(34,857 posts)2013 the Dems controlled the Senate and Obama had just taken his oath for a second term. That was the time to retire.
