(Calif. AG) Kamala Harris seeks to block 'kill the gays' ballot measure

California Attorney General Kamala Harris asked a court Wednesday to intervene and allow her to block an incendiary proposed ballot measure authorizing the killing of gays and lesbians.

Huntington Beach attorney Matt McLaughlin paid $200 to file the “Sodomite Suppression Act.” Last week, experts told The Bee that state law affords Harris little choice but to write a title and 100-word summary needed for proposals to advance to the signature-gathering stage.

“As Attorney General of California, it is my sworn duty to uphold the California and United States Constitutions and to protect the rights of all Californians. This proposal not only threatens public safety, it is patently unconstitutional, utterly reprehensible, and has no place in a civil society,” Harris, a candidate for the U.S. Senate, said in her first public statement about the proposal.

“Today, I am filing an action for declaratory relief with the court seeking judicial authorization for relief from the duty to prepare and issue the title and summary for the “Sodomite Suppression Act.” If the Court does not grant this relief, my office will be forced to issue a title and summary for a proposal that seeks to legalize discrimination and vigilantism.”

California's initiative process contains provisions for two different kinds of initiatives. Constitutional initiatives change the state constitution, while statute initiatives change state law. Constitutional initiatives require 585,000 signatures to get on the ballot, while statute initiatives only require 365,000.

The so-called "Sodomite Suppression Act" is written as a statute initiative that wants to add laws to the penal code to criminalize homosexuality. The problem is, the proposed initiative contains several items that would override protections built into the state constitution. That means it's a constitutional initiative, and not a statute initiative.

Ergo, the guy is a dumbass who isn't even capable of formatting his hatemongering initiative properly. Because his proposal overrides the state constitution on several points, it needs to be written as a proposed constitutional amendment. As it's currently written, it's not even a valid initiative. I'm not sure why the measure hasn't already been rejected on that technicality alone.

Taking it to court based on the content is a losing battle. Attempts have been made to stop propositions based on their content and impact before, and they have failed. The courts have pretty much universally agreed that our initiative system means that it's "up to the voters". Because Prop 7 created an initiative system that made propositions equal to the courts, legislature, and governor in stature, the state courts simply lack the authority to prevent propositions from making it to the ballot (though they do have the authority to strike down unconstitutional statute amendments after the fact).

The near invisibility of the filer, combined with the beyond belief content make it difficult to ascertain the motives, or even ascertain that this guy is for real.

Plus on any initiative you have to add about 10-20% to account for possible errors, so he probably needs closer to 700,000. It will never happen.

I'm torn about this. On the one hand, one's natural reaction is to expose this horrible bigotry, partly so that people are aware of this specific proposal and more broadly because it shows the mask ("protect traditional values", etc.) slipping from the ugly true face of homophobia. On the other hand, as DUers have pointed out, it's unlikely that the measures proponent(s) will actually invest the time and money necessary for a serious attempt to get the signatures; it's still less likely that, even if they do, they'll succeed in getting on the ballot; it's extremely unlikely that it would pass; and inconceivable that it would survive judicial scrutiny.

McLaughlin pays a $200 filing fee and gets incalculably more than that in free advertising for his hatemongering.

I was kinda looking forward to seeing him try to collect signatures. He will get his ass kicked more than once.

Sometimes its best to let these people have their say so it can be demonstrated just how thin their support is.

These yahoos keep accusing the Government of trying to put them on a list. Wouldn't it be ironic if they created the list for us?

is the fact that only a very very very small minority of gay haters would actually agree that they should be all killed. Most people have relatives or friends that are gay, or they believe "thou shalt not kill" from their religion or just common fucking sense. This would NEVER pass, even in Arizona!
