Michael Brown's parents file civil lawsuit in Ferguson police shooting

CLAYTON, Mo. The parents of Michael Brown filed a wrongful-death lawsuit Thursday against the city of Ferguson over the fatal shooting of their son by a white police officer, a confrontation that sparked a national protest movement.
Attorneys for Brown's parents, Lesley McSpadden and Michael Brown Sr., filed the complaint at the St. Louis County Courthouse and called a news conference to announce the case, which had been expected for months.
Messages seeking comment from Ferguson Mayor James Knowles III, city spokesman Jeff Small and an attorney for Darren Wilson, the officer who shot Brown, were not immediately returned.

Civil cases generally require a lower standard of proof than criminal cases. Jurors must find a preponderance of evidence, not proof beyond a reasonable doubt needed to convict in a criminal trial.

(129,103 posts)That's bullshit. "Violations of civil rights" laws are weak thanks to the white supremacists who run Congress, which ties the DOJ's hands by design. "Wrongful Death" civil suits are easier to pursue.

(53 posts)Wilson acted in self defense or he didn't, and the DOJ found he did. That has nothing to do with Congress.

I.e., the "high bar", in essence, the intent as a (racial) hate crime (e.g., if Wilson had been a KKK member, that would have helped in this instance). And you also had the unfortunate situation of witness testimony that ended up all over the fucking place (i.e., some witnesses who claimed to be there and weren't, etc.)... so the case was doomed from the start.

(5,586 posts)And I don't see how the Browns can overcome the physical evidence to prove this case.
I just don't want them to owe money to Darren Wilson at the conclusion of this trial, which they are far more likely to lose than Wilson.
I suspect Wilson has already put most of his assets and property beyond the reach of a lawsuit just in case he were to lose.
