Israel Responsible For Gaza Strikes On UN Schools And Shelters, Inquiry Finds

Source: Guardian UK

Israel was directly responsible for the targeting of seven UN premises used as civilian shelters during the 2014 Gaza war, an inquiry ordered by secretary general Ban Ki-moon has concluded.

Releasing the report on Monday, Ban condemned the attacks – in which some 44 Palestinians died and 227 others were injured – “as a matter of the utmost gravity” and said “those who looked to them for protection and who sought and were granted shelter there had their hopes and trust denied.”

Ban insisted that UN locations were “inviolable”.

Ban ordered the inquiry in November after thousands of buildings were destroyed and at least 223 Gaza schools, either run by the UN refugee agency or the Islamic militant group Hamas government, were hit in the fighting.

4. A Legal and Operational Assessment of Israel’s Targeting Practices
Mon Apr 27, 2015, 03:21 PM
Apr 2015

Over the course of 50 days in the summer of 2014, the Israeli Defense Forces conducted a high-intensity air and ground campaign against Hamas in the Gaza strip. Sparked by the murder of three Israeli teenagers by Hamas militants, this short but violent conflict resulted in over 2,100 killed on the Palestinian side, as well as widespread destruction and damage to civilian infrastructure. Israel suffered roughly 70 casualties during the operation, including IDF soldiers killed in battle and Israeli civilians struck by Hamas’ indiscriminate rocket attacks against Israeli population centers, which also took a large psychological toll on terrorized Israeli civilians. This latest chapter in the long saga of conflict between Israel and Hamas provides another salient lesson in the horrors of war, but also a new opportunity to examine the operation of the law of armed conflict principles in practice.

-snip-

Broadly speaking, we concluded that IDF positions on targeting law largely track those of the United States military. Moreover, even when they differ, the Israeli approach remains within the ambit of generally acceptable State practice. The IDF is served by a corps of highly competent and well-trained legal advisors who operate with a remarkable degree of autonomy, and its operations are subject to extensive judicial monitoring. While there are certainly Israeli legal positions that may be contentious, we found that their approach to targeting is consistent with the law and, in many cases, worthy of emulation.

7. Maybe their policy is just fine, but their actions in this case didn't follow that policy. From the article:

The issue is particularly sensitive as the locations of all UN buildings – including schools used as shelters – are routinely provided to the Israeli military and updated in times of conflict.

But they are very popular as after-the-fact justifications for the many and repeated "errors" that occur when you resort to violence as a first choice to solve problems.

The US trots out the same justification ("we are very careful, really&quot for it's stupid drone war, and nobody who is not emotionally involved believes that either.

Watching that war last Summer, I thought the IDF was doing it's best to try to drive the Gazans into the Sinai with artillery (Well, it worked before, right?), and only the fact they had no way to get there prevented it from succeeding.

I suppose it is "better late than never" that the UN is finally noticing the many Israeli war crimes and assorted violations of International Law. The question is, what will come of it? Or rather what will the US allow to be done?

When both sides of this conflict utilize the same tactics, who holds the moral high ground?
Israel would have us believe its them. Unfortunately Israel is equally guilty of using Palestinians as Human shields as evidenced by documented footage on Youtube as well as U.N reports.
So lets cut all this BS about Human shields and "Terror tunnels" after all Jews in the Warsaw Ghetto used tunnels to smuggle goods in and attack the Germans.
So again who holds the Moral high ground?
Neither, Its about time both sides grew up.

Israel, of course, is aware of this but chooses to target children, civilians in general, hospitals, schools, water treatment plants, electricity generating plants, and other soft targets. Much like the US did in Iraq, by the way.

between Hamas storing weapons in schools, and Ordinary Palestinians Knowing weapons were stored in schools whilst they were seeking shelter there.
There are no winners in this situation.
Humanity should dictate you err on the side of caution and don't bomb the school killing innocent children in the process.
As i said there are no winners.
