Friends set up gofundme page for woman hit by bat at Fenway

BOSTON (AP) — Friends have started an online fundraiser for a woman hit by a flying bat during Friday night's game between the Oakland Athletics and the Boston Red Sox.

Tonya Carpenter remained in serious condition Sunday at Beth Israel Deaconess Medical Center in Boston. She was struck in the head by Oakland player Brett Lawrie's bat as she sat between home plate and the third base dugout at Fenway Park with her son and a friend.

Her friends say on their gofundme page 44-year-old Carpenter was lucid after surgery Friday, but faces a long recovery. They say she's "a beautiful, positive, upbeat, hardworking single mom who would do anything" for family and friends.

Her family says in a statement they're "grateful to all who have reached out with thoughts and prayers."

There is the assumption of risk when you go to a baseball game and every ticket has a liability waiver.

That said the team should help out to generate some goodwill and I could see a lawyer trying to sue anyway to see what happens.

The introduction of new more easily broken bats has been an issue for several years. It might be enough to void the liability waiver, especially if the MLB has non-disclosed information about the risks. If the risks are not what a reasonable person would ordinarily assume, or if they have changed substantially and especially if the party requiring the waiver is concealing material information, the waiver can be quashed as unconscionable.

(We agree to liability waivers for concerts, but if the concert venue or promoters create unsafe conditions (pyrotechnics that cause fire and crowd crush, for instance) unknowable to the audience in advance, they can still be sued. The same principle could apply here).

That the Franchises carried a ton of liability insurance..Owners make so much freaking dough, you’d just think that event like this would happen so infrequently, that liability insurance would be cheap.. Guess not..

Gofundme takes 5% of the donations just to put up a page with link to a payment processor site where you have set up your own account anyway and then pay 2.9% + $0.30 more for actually handling the transaction. I really hate to see people in need being shamelessly exploited like that.

ETA for anyone who finds themselves needing a donations campaign: There is no need to pay gofundme that 5%. You can open a PayPal account that accepts donations and put the Donate buttons anywhere. If nothing else, there are free web hosting services where you can set up a subdomain, or you can get your own website for about $5 per month including a domain registration. In either case, you just need an HTML page that explains the campaign and puts up the Donate button. Then, you can link to that page from Facebook, Twitter, etc. -- anywhere you could link to a gofundme page.

ETA again: I just did some digging, and it turns out you can actually create a page on Facebook and embed a PayPal donation button, so you don't need any other website. In Facebook you can create a page (e.g. a Cause or Community page) that describes the campaign. In PayPal, you can generate the HTML for a Donate button and copy it. Then go to this link: https://apps.facebook.com/static_html_plus/
There, you can create an "app" to add to your page that has any HTML you want. Select your created page and create the app, then when you go back to the page, there will be an Edit App button. Click that, paste the PayPal HTML for the Donate button there (and anything else you want to add as HTML), save it and you're finished.

where health care was a basic human right and there'd be no need to try to fund health care from donations.

Just remember next time you are on a jury for a personal injury case. If the claim has merit, the Plaintiff/victim is entitled to recover for those things as well as pain and suffering.
The corporate Tort Reform movement has brainwashed people into thinking they are all frivolous cases. They even twisted what happened to the McDonals coffee lady. She almost died and lost her labia and clitoris because Mickey D's decided to super-heat the coffee to get more per bean and stay fresh longer causing 2nd and 3rd degree burns!
