Documents detail police shooting of boy holding pellet gun

CLEVELAND (AP) — Investigators have found no hard evidence a Cleveland police officer who fatally shot a 12-year-old boy carrying a pellet gun ordered him to raise his hands before opening fire.

Documents released Saturday by the prosecutor handling the racially charged case detail the moments before the brief, deadly encounter — and how the responding officers seemed almost shell-shocked as Tamir Rice lay dying outside a rec center.

Cleveland police have said the officer who fired the fatal shot, Timothy Loehmann, told Tamir three times to put his hands up, then opened fire when the boy reached for the pellet gun tucked in his waistband.

Grainy, choppy surveillance video shows Loehmann firing two shots within two seconds of his police cruiser skidding to a stop near the boy. Cuyahoga County sheriff's detectives investigating the shooting wrote that, based on witness interviews, it was unclear if Loehmann shouted anything to Tamir from inside the cruiser before opening fire.

immediately upon exiting the vehicle. There's no way that he could have given the order three times unless he was yelling out of the window before they pulled up to the park bench.


This case is a textbook example of how police unions will back anything that an officer writes down in a report to cover his ass no matter how absurd or implausible.

I am NOT saying that these officers used it though, just pointing that you might be mistaken that there is no way for them to have told him other than yelling out a window.

who have commands barked at them through a loud speaker by the police show some kind of reaction. He seemed to be minding his own business until the cruiser pulled up next to him.

That I can't find, was that he was told to drop his weapon. Which would explain why he went to get it as they pulled up. When the video came out, it was hands up.

They are full of shit, the murdering pigs.

Did you miss this story? Yes. And according to the article, it wasn't the first time the loons have done this. A decision was made to not go Waco or Ruby Ridge on them. It's apparently SOP.

If I recall this case correctly, the original 911 caller said the child had a gun that was quote "probably fake". So, it was called in as a kid waving around a toy gun and scaring people with it.

this case are black? This is a case of an incompetent cop shooting a child with no cause - period. Any parent or grand parent should be extremely angry regarding this killing. This was a child like any of our 12 year old children. And yes those of us who are not black also are very upset about this so called racially charged case.

Also when are the cops going to realize that we do not believe their old cliché - "reached for his gun in his waistband". That is worse than "the dog ate my homework". The cops need to think up some new material.
