(22,651 posts)Its really expensive to fight against government officials in court, even if the Lawyers your group has, work for free.
It could take years even if the group keeps after the criminal. Walker knows that.
Walker-Koch people may even 'file a court case' just so Walker can silence witnesses and use the BS line when questioned by the press as he campaigns....
"sorry I can't comment about a court case"

(2,367 posts)really because SCOTUS can overrule itself. Though they rarely do).

(14,779 posts)From what I have read it is an matter of STATE LAW and if that is the case, there is no appeal. If it is an issue of Federal Law, people could file in Federal court and go up the entire federal court system, but only on issue of FEDERAL LAW, not state law.

(2,367 posts)likely be bias/corruption, since the conservative judges in WI were also funded by club for growth.
SCOTUS has already ruled that a judge must recuse him or herself if there is a conflict of interest, so this is one argument that could be made.

(14,779 posts)And this was a STATE INVESTIGATION of a violation of STATE LAW. Thus no Federal issue, no Federal jurisdiction over the case.

(32,049 posts)SCOTUS has no jurisdiction over state law issues. No credible lawyer would make a useless appeal.

(24,710 posts)and the Department of Justice I believe can step in, he is not really immune under the federal statues since they are worked side by side in all investigations.
This really is in the federal appeals court to override this--------------what a scum bag judicial system in Wisconsin, it really is corrupt---no wonder there ranked 38th in job creation and
#1 in organized crime

(4,450 posts)A majority of the Wisconsin Supreme Court are bought and paid for Walker supporters. This is why it was such a big deal when David "the Madison Strangler" Prosser miraculously "won" his re-election over Kloppenberg when what's her name in Waukesha County miraculously "found" a few thousand votes for Prosser on her laptop after it appeared he had been defeated.
The Wisconsin Supreme Court is as dirty as any court in any banana republic third world country you want to pick. The conservatives all took huge amounts of money from Plaintiffs in this case and still refused to recuse themselves. My home state is a joke. If you want to know a huge reason why Walker keeps getting his way, look no further than the Wisconsin Supreme Court.

In an interview, Justice Prosser declined to discuss the Walker campaign case, but spoke generally of the factors involved in making a recusal decision, including the timetable of contributions in support of a judges campaign.
The effect of even large contributions can wear off after a reasonable amount of time has passed so long as it doesnt involve a case that was pending at the time the contribution was made, Justice Prosser said. Timing is a very significant factor recognized by all legal experts. (March 28, 2015)

(11,014 posts)This only sprays deodorizer on the stink ... the stink will eventually win. If Walker was not running for POTUS, it could have been hushed up but if he gets the nomination, some reporter/s would want to uncover what happened and make a career.

Bottom line in many cases republicans stay in power by elcetion fraud
and dirty judges.
BTW I will never believe that Scott Walker won his recall vote.

THIS is what can happen if a CON gets back into the White House.
You think for one instant that a president scott walker would appoint anybody like a Sonya Sotomayor or an Elena Kagan to the high bench? THINK ABOUT IT.
BECAUSE we had the two of them in there, we were able to get some recent rulings we could celebrate on the issue of the ACA, marriage equality, and fair housing. If either mccain or romney had won, there'd be no way on God's Green Earth that we'd have had two additional liberal-leaning associate justices on the Supreme Court. No chance in hell.
