Lawsuit accuses CVS of overcharging for generic drugs

SAN FRANCISCO (AP) CVS Health Corp. deliberately overcharged some pharmacy customers for generic drugs by submitting claims to their insurance companies at inflated prices, according to a lawsuit filed Thursday in federal court in San Francisco.
The suit says those inflated prices led to higher co-pays for customers that exceeded what they would have paid for the drugs if they had no insurance and participated in a CVS discount program.
"We've seen people who pay $20 for a 30-day supply as their copayments on a drug that was $11.99 for a 90-day supply had they been in the (discount program)," said Kristen Broz, an attorney with Hausfeld, the firm that filed the suit.
The lawsuit seeks class-action status, a court order prohibiting CVS from engaging in the behavior, and unspecified damages.

(51,076 posts)I typed in the number on my prescription of one of the meds I take in google and it took me to a page that showed what the VA system was paying for the drug. They were/are paying .04 cents a pill and are charging me $8.00 copay for a bottle of 84 pills. One month supply

(51,076 posts)These sunsabiotches need to be brought up on charges and given their day in court. If convicted, punished to the full extent of the law.
Nothing else we do as a society concerning health care matters until we fix this.

I was at a pharmacy (within a grocery store), it was a January. The older woman in front of me was told that her copay had increased to $25. She told the tech, to put the prescription back, she couldn't afford it.
I'm an idiot, but i stopped the woman and asked her if she would tell me the medication, as I had a senior citizen mother, and I managed all her prescriptions.
The woman said "Simvastatin", now I know this is $10 for a 90 day supply. i walked her back to the pharmacy and we both talked to the Tech. She got the prescription for $10. The Tech kept saying, "but you have insurance" my answer was "but she doesn't have to use it".

(34,137 posts)Another DUer recommended it a while back and I've used it for my most expensive prescription. You can go to the site and check which pharmacies have the lowest price both with and without the GoodRx coupons. The site is free, the service is free and they don't spam you. If you register you can put in all your prescriptions to make it easier to check the prices - and they will send you a card so you don't have to print coupons. Plus I just got an email from them on a recall for one of my generics that neither my doctor or my pharmacy had told me about.
My expensive prescription was $287 without a discount (and WITH insurance). With GoodRx I got it for $29.97 at CVS. Each month I check how expensive it is before getting it filled and transfer that one to the cheapest place.

Will check into this! Even one of the doctors I go to told me to mail order from ... Canada!

I was hoping that the ACA would set up negotiations and better price control for medications but the pharmaceutical companies wouldn't allow it. It is insane that this country has such high prices for medicine!

We need reform not more of this B.S.
Since when should a person that is paying through the butt have NO ACCESS to a doctor?
No one answers this question, not even Medicare!!!

(34,137 posts)Without the ACA we couldn't get private insurance at all and my husband would still be working at a job that was wrecking his physical and mental health to get coverage. I let him retire two years before he was eligible for Medicare because we could be covered under the ACA.
Medicare will cost us more - in fact I may stay on an ACA policy because I never paid into Medicare and it will probably cost me more.
ACA is nice because you can look up which doctors will take your policy and select the ones with doctors you like. Unfortunately the company with our policy is quitting ACA after this year and we will have to look for a new one this fall.

and yes, I am one of them, a totally disabled American WITH pricey heath insurance and good damn luck finding a doctor and welcome to your Part D Medicare RX drug benefits of $100.00 a pop!

(14,255 posts)the psychiatrist (paid doctor cash every three months, minimum visit to get script) were priced at $1446 at CVS, $1198 at Walmart, $1572 at Publix. Generics, except for the Venlafaxine XR. CVS was $170. (No membership needed.) Four medications, 90 days supply. I broke down and cried, we had been buying a few pills at a time at CVS, which, of course, is even more expensive.
No one would/could beat the Costco price.
(Big thanks again, to hollysmom, who told me about Costco!!!!)
The poor and uninsured are shamefully ripped off, and must do without or ration.
