Florida’s attorney general won’t pay legal fees after losing fight against same-sex marriage

After fighting tooth and nail to deny same-sex couples the right to get married, Floridas attorney general is now refusing to reimburse attorneys representing the couples in the case she ultimately lost.
Florida Attorney General Pam Bondi has objected to a motion from lawyers attempting be compensated after representing gay couples seeking to have their marriages recognized in Florida, only to have Bondi continue to appeal higher and higher up the legal system, reports the Tampa Bay Times.
According to Bondi, Florida voluntarily dismissed its last appeal after the U.S. Supreme Court made same-sex marriage the law of the land, and therefore the state shouldnt have to pay for the lengthy appeals process it put litigants through.
Its ludicrous, said Elizabeth White, a Jacksonville attorney who represented one of the couples who challenged the states gay marriage ban. Quite frankly, the state vigorously litigated this. Now theyre saying, We lost, but we dont want to pay. Attorneys who worked to defeat the marriage ban said they have not come up with the exact amount they are owed, but an estimate of $500,000 was suggested.

(113,388 posts)The state of Florida was sued. It is the job of the attorney general to defend the state against suits. There's nothing pernicious about appealing a judgment on a question on which the Supreme Court has not ruled. When the Supreme Court ruled on the issue, Florida withdrew the appeal.
There is no court order awarding fees in this case. The plaintiff has filed a motion for fees, and the state has filed a response to that motion. The court will decide whether or not the state owes the fees.
Absent an obligation to pay the fees, is the idea here that the state should just pay them?
It'll get sorted out.

Fees are not ordinarily awarded in civil litigation absent exceptional circumstances, or in a civil rights action in which the plaintiff prevailed. In this particular case, the plaintiff didn't prevail, but FL withdrew their defense when the Supreme Court ruled on the underlying issue.
The plaintiff's attorneys have filed a motion arguing for fees. The state has filed a response to that motion arguing against fees.
It's going to be up to the court whether FL has to pay the fees, after considering the arguments of both sides.
So, whether FL "won't pay" hasn't been decided yet.

(95,337 posts)But theres another side to this story that Attorney General Bondi hasnt included in her arguments against marriage equality: the fact that she, herself, has had a lot of experience in the marriage arena. In fact, Bondi has been married and divorced twice, and later called off another marriage before officially tying the knot for the third time.
And one was a last minute call-off before the wedding so it is married 3 times.
