Kentucky Clerk Once Again Denies Gay Marriage License, Despite Federal Order

MOREHEAD, Ky. (AP) — A Kentucky clerk's office on Thursday again refused to issue a marriage license to a gay couple, in defiance of a U.S. Supreme Court ruling that legalized same-sex marriage across the country two months ago.

Rowan County Clerk Kim Davis has refused to issue any marriage licenses, citing her Christian faith and constitutional right to religious freedom, since the landmark decision in June.

On Thursday morning, a deputy clerk in her office refused to issue a marriage license to William Smith Jr. and James Yates. It was their third attempt to get a license. They said they will not give up.

"They just don't like gay people, they don't want us to get married," Yates said. "And they'd rather burn the earth and not let straight people in Rowan County get married either." The action Thursday came just a day after a federal appeals court upheld a ruling ordering the clerk in rural Rowan County to issue marriage licenses to same-sex couples.

You advised everyone to drop their contempt-prison fantasies, and instead be consoled by the high likelihood that she would almost certainly lose the suit brought against her, and that there was a good chance she would need to pay out of her own pocket. You may have been referring to the Texas case, but either way, I was consoled. I've been having pleasant daydreams about her liquidating her Beanie Baby collection for $400 after finding out they're not worth the $75K she thought they were worth--all to pay damages she brought on herself.

She may yet go to jail for contempt, and that will play out shortly.

She'll definitely have to pick up the tab for the other side's legal fees, but she's well-funded at this point.

No doubt there is some legal remedy under the local law, but it is not going to be dismissal, that's for sure.

A panel of federal appeals judges refused to overrule a judge's injunction against Rowan County Clerk Kim Davis, who continues to refuse marriage licenses for same-sex couples more than a month after the U.S. Supreme Court found a constitutional right to marry.

Three judges with the 6th U.S. Circuit Court of Appeals denied Davis' request for a stay on Wednesday, writing that her official duties include issuing the forms and that the Supreme Court has already said states cannot bar same-sex couples from marriage.

"It cannot be defensibly argued that the holder of the Rowan County Clerk’s office, apart from who personally occupies that office, may decline to act in conformity with the United States Constitution as interpreted by a dispositive holding of the United States Supreme Court," the judges wrote. "There is thus little or no likelihood that the clerk in her official capacity will prevail on appeal."

What they dont understand is there are now enough of us, whether it is Women's rights to their own bodies, Black people having a right to function and not be shot, or a Gay person being treated equally, that we now demand this and the alternative is chaos if we dont get it.

you can do the right thing or ultimately you will sow chaos

She's a pencil pusher who should be doing her job. She isn't marrying anyone. I'm sure there are plenty of people willing to fill her spot if she can't do her job.

is the fact that these folks are still in their jobs. If they do not do what they are told, fire their asses. Do it on the grounds of refusing to perform their duties, on the grounds of insubordination, but do it on the grounds of a normal work flow process. Do not give them grounds to challenge, sue, etc.

Gays, blacks, Muslims - the motivation for their actions is irrelevant.

You do not do your job, your ass is out the door. End of story.

And that whole side story about dying for what you believe in...That is one of the best 'milk through the nose' lines I have heard in a while.

I realize Kentucky is a red state, but does no one there have any balls whatsoever? They sure act ballsy about so many other things.

The Kentucky house has 54 Democrats and 46 Republicans.
Republicans control the Kentucky State Senate.

Assuming impeachment works as it does at the Federal level, the House could impeach but she would not be convicted.

That assumes that Democrats would actually impeach her, an act that would amount to throwing a political torch into gasoline.

I assume that those she refuses to grant marriage licenses to could take her to court, or she could be arrested and tried for violation of civil rights.

Maybe there are sovereignty strengths to states set up as commonwealths, I don't know.

Nothing reveals the absurdity of her position more clearly than her lawyer's response to the latest ruling against her. Liberty Counsel chairman Mat Staver continues to insist that elected public officials have a constitutional right to pick and choose which of their government duties they will perform based on their religious beliefs — in other words, that public officials can use religion to discriminate against certain citizens.

Nothing could be more un-American. What he is advocating would destroy the rule of law, a foundation of our republic. And imagine the chaos, given the wide range of religious beliefs.

Churches and clergy are still free to limit marriage according to their religions' beliefs, but public officials must follow the law and treat all citizens equally.

Why Liberty Counsel chose Kentucky to make its losing stand is not clear; we do have one of the few governor's races this year. ... What is clear is that all the citizens of Rowan County are entitled to a full-service clerk's office that follows the Constitution. Davis should provide that or step aside.

Casey County Clerk Casey Davis, who recently embarked on a bicycle ride from Pikeville to Paducah, made a stop at the Rowan County Courthouse on Friday morning to show his support for Rowan County Clerk Kim Davis, who is still refusing to issue marriage licenses despite a federal court ruling.

Dozens of people showed up Friday morning at the courthouse from both sides of the marriage argument to express their beliefs.

Casey said that he and Kim have no hatred for gay individuals or marriage equality supporters. But he said he can’t let the authority of man supersede the authority of God or the authority of nature.

As for resigning, Casey said that’s not an option.
