Man accused of harassing American Indian students cleared

RAPID CITY, S.D. (AP) — A judge has cleared a South Dakota man accused of harassing American Indian children with racial slurs and spilling beer on them at a minor league hockey game in Rapid City.

Magistrate Judge Eric Strawn filed his decision Tuesday acquitting 41-year-old Trace O'Connell.

O'Connell had pleaded not guilty to a disorderly conduct charge in the January incident that spurred protests by Native Americans who believed the charge was too lenient.

Strawn in July oversaw O'Connell's two-trial, which drew as many as 250 spectators.

Spend a few days recently visiting family in Eastern SoDak,thought we were is some Republican Time Warp. Some comments we heard at a Lake Side Bistro;damn Indians all they want is their Government Checks so thy can buy more booze and drugs,Friggin lazy,get a job. Spent my childhood near and around Reservations in Northern Wisconsin,seen the bigotry,heard the cat calls,and other demeaning garbage. And if a Native heaven forbid got caught up in the Wisconsin Criminal Justice System,kiss his or her ass good by .

This case being thrown out doe not surprise me in the least. These Judges are elected and South Dakota has gone Libertarian 100%. The Native American Population is exploitable,corporate America wants the Minerals and Oil under their land. ALEC did their thing in SoDak,and it is just one of their many Incubators for thing to come.

are a big lie told by racists as you probably know. But most people do think that the Native Americans receive checks just for being Indian. If their tribe sells resources they do get paid for that. We should all try to set that record straight when we can.

Do Indians get payments from the government?

No individual is automatically paid for being an Indian. The Federal Government may pay a Tribe or an individual in compensation for damages for losses resulting from treaty violations, for encroachments on Indian lands, or for other past or present wrongs. A Tribe or an individual may also receive a government check for payment of income from their lands and resources. This occurs because their resources are held in trust by the Secretary of the Interior and payment for their use has been collected from users by the Federal Government in their behalf. Fees collected from oil or grazing leases are an example of this situation.

I for one have known this my entire live,but,the Media and the prevaricators of hate and animosity exploit non Anglo-Saxons for monetary gain. Have been watching for the final actual check to be sent and cashed by the Navajo Tribe in Northern Arizona. Another example of false stories as to these phantom checks. Dealt with many of the Tribal Members will part timing at a DIY Store. And growing up around a couple of Reservations in Wisconsin,been there done that,people will believe anything that might sound plausible or that might threaten their personal environment. Of course we have so called Religious spoke persons that really stir the pot of dissension cause that land them folks are livin on belongs to the White Man.

There are 3 "Reservations" (I hate that term) within 15 minutes of my home, two of which have Casinos.

I'll never forget sitting next to a youngish guy playing slots ... as he put in his last money, he went off on a tirade about, "these F'ing cheating ass, Indians ... taking our money." (and much, much more)

After he paused for a minute, I looked him in the eye and asked him, loud enough for everyone around us to hear, "Dude ... You want me to call the police? Because, you must have been kidnapped and dragged kicking and scream into this casino! They money they are getting is the money you are giving them."

Of course, then, I became everything but a child of God ... in his mind ... He was wise enough to not let what was in his eye, close his lips.

I bet some of the people at the table got a kick out of what you said.
The ignorance is just amazing. I was talking with a man about the removal of our dams to restore salmon runs. He said "they only did that so the Indians could get the salmon." I asked him if he didn't believe in honoring treaties. Of course he didn't have an answer. He then just kept repeating several times that the Indians get all the salmon and I was brainwashed by the environmentalists.

Bigotry is a cement wall around the stupid. I really don't know what changes that.

excuse for hatred not only by the rw in SD but by little old ladies setting in a church in total ignorance of what is going on.

My sister and I used to work with a group of Native students who were asked to speak at various churches in NE and SD. Invariably we would hear about the government checks. Sometimes as pure hatred and other times as out of ignorance.

The truth is that the BIA often holds money paid to a tribe from some law suit or from rent for their land etc. They hold the money in trust for the tribes and pay it a little at a time (either monthly or yearly) to the members of the tribe.

There are lawsuits setting in the federal courts that have set there for decades and occasionally one gets settled. In areas where there is oil and coal the government often collects the money and again pays it out to the members.

That is what the government check propaganda is all about. It is NOT welfare. And it is nobody else's business how they use it.

which is another issue. Humans being just that,seem to have a built in dislike gene which can be turned on when ever they them selves feel threatened,and as I have mentioned before,stupid hate filled things are spread as fact by some one or some group that feels no matter if it is false,screw it,I say it is fact and off it goes. Growing up by Native Communities,seen the exploitation of their Communities by the Anglo Saxon's,and the local Law Enforcement looked the other way. Now the area has a Casino,hoop-de-do,the land for the Casino belonged to one of the most Exploitative persons in the area. Yes,tribal members are so a certain extent better off,some new Housing,new Clinic,paved streets and Sewer and Water. Not all of the Band Members share in the wealth,it seems to be controlled by the Band Chairman and her extended family. Family feuds transcend the passage of time,and we wonder why there is so much false stories about how wealthy the Natives are,they are mired in their own Political Corruption problems.

And yes,the comment about the little old ladies is right on. Just heard the same crap yesterday when we stopped at a local Hy-Vee to pick up supplies. My spouse turned to me like she was about to clobber both of the old bitties,that would have been classic,we are both older than dirt,and Senior Cat Fight would have been interesting. The Cashier noticed our a taken back by the old girls,and she says,lots of the old people here still think the Indians are rich cause they got that Casino.

though. Prior to that most Natives had no jobs at all. In the 70s I remember 2 men in the tribe that had jobs off the reservation. The local community did not hire Natives.

Now WE are the biggest employer in the area and WE hire all races. Plus the locals were sure that we would never be able to run the casino and it would go down in flames because we were not business people. No one is thinking that anymore. Our RBC is perfectly capable of doing business.

Another result is that since we now have jobs our kids are seen in a totally different way in the schools. Teachers no longer see them as failures in kindergarten. We now have children who are on the sports teams, in the band, graduating and going on to college. No longer is education seen as a dead end action forced on us by the white community.

However, the biggest thing you were correct about is inter-tribal politics. The in fighting is one of the biggest problems.

intertribal feuds are a problem. My home town and surrounding towns and villages would not hire anyone from the Native Community until a neighbor and I'am referring area if 1950's decided to diversify his farming operation to include Berries and Cukes as well as Beans. His pickers came from the Native Community,ironic was the pay was the same as the local Dairy Plant. Did this Guy pay the ultimate social price,members of our Church moved to have him excommunicated,and the business dudes on Main Street refused goods and services because of their down right hatred of the Natives. His wife would make up her shopping lists and I would fill it for her. Got to remember,they supplied food and clothing to the Native communities as a gesture of good will and compassion. And this continued for about five or six years,when health issues took him at 55. After that,thinks really got sticky,his family tried their best to continue with the farm,and the enterprise was liquidated within the first year.

As I mentioned before,one of this fellows major distractor's was the Guy who sold his highway frontage to the Tribe for their now Casino. Strange bedfellows to say the least.

better. Ours is an open reservation which means that there is white owned land mixed in with Native land so you next door neighbor can be a Native. Plus many of our band members are now buying houses in the white communities.

Here it is interaction and intermarriage that works to improve conditions. Kind of hard to hate your own grandchild.

And Grand Kids are forever. We do our best to make darn sure they are prejudice free. And to think American History or what I call Revisionist American History has been excluded from many school systems. Our Local District only uses post 1900 as a time frame,what the hell is that. There again is another F--ed up story on how one Cult controls 300k kids.

family reunion this weekend. It was very interesting. One thing everyone could agree on was volleyball.

But we all had fun and are hoping to repeat it again next year.

I know that if my friends and I were to witness something like that, it wouldn't have sat well at all. A couple of those guys would have been followed to the restroom for a discussion on manners and etiquette.

Many of the non-Indians are resentful because they have to pay the tribes for exploiting their resources, such as timber, oil, minerals etc. They feel the tribes are taking "their" money, and they have a lot to say about the run-down appearance of some of the reservations. So we have places where there are many non-Indian oil workers, truck drivers, etc. who resent the Indians because they sometimes get by without working. Some farmers and landowners are at odds with Indian people because they're allowed free access to certain places, and can hunt out of season, etc. I would like to know more about this O'Connell guy.
