Is Pender within Omaha Indian Reservation boundaries? U.S. Supreme Court to hear arguments

Source: Omaha World Herald

By Paul Hammel

LINCOLN — The U.S. Supreme Court has agreed to hear oral arguments on a dispute over whether the town of Pender, Nebraska, is within the boundaries of the Omaha Indian Reservation.

Nebraska Attorney General Doug Peterson made the announcement on Thursday.

In May, Peterson had asked the nation’s highest court to resolve a long-running dispute over the issue.

One of the latest court decisions came in February 2014, when Senior U.S. District Judge Richard Kopf ruled that Pender was within the reservation’s boundaries. That opened the way for the Omaha Tribe to begin levying a liquor tax on taverns in the northeast Nebraska community of 1,002.
