Obama apologises to MSF president for Kunduz bombing

US President Barack Obama has apologised to the president of aid agency Medecins San Frontieres (MSF) for a bombing that killed at least 22.
The US has said the bombing, which took place in the Afghan city of Kunduz, was a mistake and it was attempting to strike the Taliban. MSF wants the bombing to be investigated as a war crime.
Mr Obama has also apologised to the president of Afghanistan. "If it is necessary to hold individuals accountable, that will be done," said White House spokesman Josh Earnest.
Mr Obama "expressed his condolences" to MSF president Joanne Liu, said Mr Earnest. "In the United States when we make mistakes, we're honest about it. We own up to it," he said.

John Bellinger, a former legal adviser to the State Department, says the bombing of the hospital was a terrible tragedy, but he believes it would be a rush to judgment to call it a war crime.
"The mere fact that civilians are killed, that a hospital is damaged, doesn't automatically mean that there has been a war crime," he says. "It only becomes a war crime if it is shown that the target was intentionally attacked."

(6,891 posts)after the coordinates of the hospital were given to the US military the hospital was attacked serves as circumstantial evidence that it was no accident.

(14,779 posts)When I was in the field artillery the forward observers were told NOT to give the gun bunnies (the people firing the Artillery pieces) their coordinates, for those Gun Bunnies would write them down and then use those coordinates to drop shells on the forward observers. It was better for everyone if the gun bunnies only had coordinates that were targets.
On a more serious note, in Vietnam, sticks were put into the ground around some artillery pieces to indicate to the gunner they were aiming at something they were NOT to hit Thus if they received a fire order the tube would hit the sticks and they be on notice NOT to fire. The question is did the planes dropping the bombs know that the Hospital was off limits? If the pilots did not know why? Given modern computers the location should have been in the aiming computer (or whatever the Pentagon calls its electronic bomb sights) with a requirement for manual over ride ONLY if under attack. I suspect the coordinates of the Hospital was in the "aiming computer" and the pilot overruled the computer. Thus the real question is why and under whose orders? The pilot could have done it themselves based on a fire mission request from someone on the ground (Some officer or special forces personnel) who decided the hospital was where the Taliban was taking their wounded and thus a military target (NOT a real military target, but a military target in the mind of the person who called in the air strike). coordinates
I suspect the problem is a special forces person called in the Air Strike for he saw Taliban going into the hospital with weapons. The problem is US personal under fire would do the same when they are taking wounded into a hospital. When you are taking someone for emergency treatment, you do not think about putting your weapon down, you do as you are trained, you secure the weapon to your body, freeing your hands to help the wounded, but the weapon is still on you. That is how ANYONE in the military who has a weapon is trained to do. Thus the mere fact that people going into a hospital with wounded have weapons does not make the hospital a legitimate military target, but ou personal is also trained to drop bombs on anyone they think is a Taliban who have a weapon. Thus the problem is TRAINING and thus under Nuremberg it is the COMMANDERS in charge of the overall operations that are guilty of the war crime NOT the pilot who dropped the bomb or the Special Forces personal who ordered the dropping of the bombs. Both did as they were trained and thus the problem is the people who set them into combat with inadequate training, i.e. the Generals in Charge of the overall operations and no one wants to go after the Generals.
