Lebanon With just days before the New Hampshire primary, the presidential campaign of Sen. Bernie Sanders, D-Vt., is taking heat from Upper Valley residents who say his campaign used their images on mailers without their permission.
When American Legion state officer Tom Wiley, of Canaan, was called by the Legions top officer in New Hampshire, Wiley didnt know what it was about, but he said the tone of state Cmdr. John Graham made it clear something was wrong.
He called me, quite straightforwardly, and asked me, had I endorsed any candidate, Wiley said Saturday. He asked specifically about Bernie.
It was a sensitive subject, Wiley knew, both because the American Legion fiercely protects its image as a nonpartisan organization, and because Wiley is in the early stages of a campaign himself, for the post of New Hampshires Department Commander. If he were found to be guilty of flouting the groups bylaws, it could sink his chances. I said, No, Ive never even shook his hand, said Wiley.

His campaign apologized to the newspaper and replaced the video on YouTube with a new version. Both the old and new version quote an editorial that appeared in the Valley News more than a year ago that welcomed a Sanders candidacy, noting Sanders has been genuinely outraged about the treatment of ordinary Americans for as long as we can remember.

(50,278 posts)Who knows if it's a German citizen in the picture or a citizen of New Hampshire? LOL. More much ado about nothing. If people do not want to be in a photo with a candidate, they should stay home and watch it on television. Since I live in NH, I just dug out all the Bernie flyers I've received this week and there are easily 3,000 people in the pictures other than Bernie and Jane. If Hillary had sent me any literature - she didn't - I imagine there would be an equal number.
No big deal.

... and cackling with gleeful schadenfreude, take a look in the upper left corner of the piece in question. It says "New Hampshire for Bernie."
Is this group directly answerable to the Sanders campaign?
Did the campaign have final approval of the piece?
Did anyone ask the agency that produced the piece if they had gotten all the appropriate releases? That seems to be the most relevant question, since the gentleman in the photo has a very good reason to NOT allow his image to be used in such a piece. There is also the possibility that it is a stock photo that the subject did sign a release for, without ever knowing who might buy one-time rights of reproduction from the stock photo agency that bought it from the photographer. It could also be that the shutterbug played fast and loose with the standard protocols applicable in such situations. A pro ALWAYS has reams of release forms in his or her possession when on a shoot. The simplistic condemnations I have read in the blatant take-down screeds do not address any of these rather important questions.
Were I thee, I would tread lightly until these questions have been answered, as the Valley News reporter should have done. To just lay this at Bernie's feet in a knee-jerk reaction could very well blow up in several faces.
I know people at the Valley News, so I will see what more I can find out. Updates as events warrant.
UPDATE EDIT: The link in the OP didn't work for me, just got a blank page, but go to vnews.com to see the article. It confirms much of what I suggested.
