Senior U.S. Supreme Court Associate Justice Antonin Scalia found dead at West Texas ranch

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.
Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.
According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.
The U.S. Marshal Service, the Presidio County sheriff and the FBI were involved in the investigation.
Officials with the law enforcement agencies declined to comment.

It was the most anti-democratic action ever flouted upon the country, imo.

(13,058 posts)Supreme Court all made by Eisenhower. And in each case the Senate subsequently confirmed those nominees to permanent status. However, a recess appointment only lasts until the end of the "next Session" of the Senate. So any recess appointment made by Obama would only last until the Senate reconvenes for its next session in 2017 unless the Seante acted before then. So the next president, Republican or Democrat would get to nominate the next permanent justice.
This does raise an interesting possibility. There are many important cases on the docket this term and even a temporary Obama appointee could make a big difference on those cases. But the stakes are so high I doubt if the Republicans who control the Senate would allow it to go out of session.

I didn't agree with some of his opinions, but there is no disputing the fact that he was an effective judge, even if he was on the wrong side of history too many times.
It is my belief that he's gone on to either heaven or purgatory - and only God can be that judge.
As for life after Scalia on the Supreme Court. ... President Obama now has a job to do.... and with a number of his actions going before the Supreme Court he'll have to pick carefully especially since there's a Repuke majority in the Senate, who will have to confirm his choice. Obama could end up picking the next justice who decides whether the Paris Agreement succeeds or fails.

This is also a reminder of why my vote in the fall is iron-clad for either Bernie or Hillary; imagine their nominees vs. the sort of cretin that Trump would be happy with.
Again, I feel sorry for the family, but the world just became a smidgen less hateful today.

If Obama does appoint someone, the GOP is going to push their base out to get out to vote to win the White House. It will be their only chance to off set Obama's appointment. We need to win and keep the White House so if Ginsberg decides to retire, she won't be replaced by another Scalia. More than ever it is imperative to turn Congress blue again. CONSIDER IF THE REPUBLICANS TAKE THE WHITE HOUSE. Who will be NOMINATING Ginsberg's replacement? TRUMP OR WORSE, TED CRUZ?

And if Obama and the Senate cannot come to terms and agree on a Scalia replacement, then the November election will be one of the most hotly contested in history.
There is a God. And I would not want to be Scalia facing St. Peter at the Pearly Gate.

NPR is opining that it will not open anything for Obama because of where we are in the election cycle. If Obama can not nominate a new judge, it means the next President will get 2 to 3 new appointments. Because several others on the bench are so old at this point.
With Bernie we could get a real FDR style court and overturn Citizen's United.

They were waiting in line at a Disney attraction, and Scalia strutted to the front of the line and pulled one of those "Don't you know who I am?" moves. My life-long Republican dad was not impressed.

And really what is Clarence Thomas to do? He can't just vote as Scalia votes anymore.
And the right are such hypocrites, if the shoe were on the other foot they would be shrieking about an up or down vote.
