Senior U.S. Supreme Court Associate Justice Antonin Scalia found dead at West Texas ranch

Associate Justice Antonin Scalia was found dead of apparent natural causes Saturday on a luxury resort in West Texas, federal officials said.

Scalia, 79, was a guest at the Cibolo Creek Ranch, a resort in the Big Bend region south of Marfa.

According to a report, Scalia arrived at the ranch on Friday and attended a private party with about 40 people. When he did not appear for breakfast, a person associated with the ranch went to his room and found a body.

The U.S. Marshal Service, the Presidio County sheriff and the FBI were involved in the investigation.
Officials with the law enforcement agencies declined to comment.

The senate has become so toxic I'm not sure how anyone is going to get confirmed. At the very least I doubt they would agree to anyone he would choose unless a Democrat won the white house going in. So it's going to remain 4-4 split until at least after the election is decided.

In a 5-4 vote the SCOTUS in 2000 defeated Al Gore's winning presidential campaign by refusing to allow Florida to have a fair recount of the vote. Scalia was a leader of this action even going so far as to say that a recount would hurt bush.

It was the most anti-democratic action ever flouted upon the country, imo.

Supreme Court all made by Eisenhower. And in each case the Senate subsequently confirmed those nominees to permanent status. However, a recess appointment only lasts until the end of the "next Session" of the Senate. So any recess appointment made by Obama would only last until the Senate reconvenes for its next session in 2017 unless the Seante acted before then. So the next president, Republican or Democrat would get to nominate the next permanent justice.

This does raise an interesting possibility. There are many important cases on the docket this term and even a temporary Obama appointee could make a big difference on those cases. But the stakes are so high I doubt if the Republicans who control the Senate would allow it to go out of session.

Because, short of Cheney, there was scarcely no one more detestable in their abuse of power, IMO.

Perhaps he was a better man in his youth....


I will say that there is a certain irony that this has happened now, since I saw a photo of him only a day or so ago and wondered how someone whose excesses were clearly undermining his health (and who frankly looked like a heart attack waiting to happen) could, seemingly be so teflon--like Cheney. I guess it does catch up eventually...

His passing seems to be sudden and unexpected.

I didn't agree with some of his opinions, but there is no disputing the fact that he was an effective judge, even if he was on the wrong side of history too many times.

It is my belief that he's gone on to either heaven or purgatory - and only God can be that judge.

As for life after Scalia on the Supreme Court. ... President Obama now has a job to do.... and with a number of his actions going before the Supreme Court he'll have to pick carefully especially since there's a Repuke majority in the Senate, who will have to confirm his choice. Obama could end up picking the next justice who decides whether the Paris Agreement succeeds or fails.

get voters out to the polls in November if Obama and the Senate do not agree on an appointment before then.

When voters get out and vote in large numbers, Democrats win. Especially if Bernie is our candidate. I don't know whether you have been out talking to voters about Bernie, but some are changing their party affiliations from independent to Democrat because they want to vote for Bernie.

There is a lot of enthusiasm for Bernie and not just among life-long Democrats.

But...this man's brand of conservatism brought demonstrable harm to many, many people over the years, from calling the Voting Rights Act "racial entitlement" to the countless nasty things he said about homosexuality during Lawrence v. Texas and on other occasions.

This is also a reminder of why my vote in the fall is iron-clad for either Bernie or Hillary; imagine their nominees vs. the sort of cretin that Trump would be happy with.

Again, I feel sorry for the family, but the world just became a smidgen less hateful today.

If I were to guess, I'd say pulmonary embolism caused by deep vein thrombosis might have got him. It's not all that uncommon for people after traveling.

It's about as offensive as saying "I know it's not polite to speak ill will of (Jewish people/black people/immigrants/etc.), but Scalia was pure evil."

People with mental illness (and I'm one) do not sit around all day thinking up ways to fuck other people over and make the world a crueler, harder place.

We already live in a world that's cruel and hard enough, and have our own experience of being fucked over, thank you very much.

You know he actually wasnt as bad as Alito or Thomas. For example he voted to protect the free expression rights of video games. And he's been good on some other civil liberties issues. He was bad overall but not the worst.

RIP I disagreed with him on a lot, but Im still sad.

We are lucky to have Obama so intrepidly engaged in his office,

But if McConnell stalls, and the Republicans reject nominee after nominee
it becomes a campaign issue. They may fare worse in 2017 if they lose

The GOP is already up in arms about this and are telling the press Obama should not be allowed to appoint a new justice. It should be postponed till after the election. If Obama does appoint someone, the GOP is going to push their base out to get out to vote to win the White House. It will be their only chance to off set Obama's appointment. We need to win and keep the White House so if Ginsberg decides to retire, she won't be replaced by another Scalia. More than ever it is imperative to turn Congress blue again. CONSIDER IF THE REPUBLICANS TAKE THE WHITE HOUSE. Who will be NOMINATING Ginsberg's replacement? TRUMP OR WORSE, TED CRUZ?

I was not a fan. He was a conservative, and although I am on the opposite end of the spectrum, I can deal with those not aligned with my views.

What I found impossible to reconcile was his complete lack of ethical boundaries. He even seemed to take joy in the fact that he could rub that behavior the left's face.

I am an atheist but this proves that God indeed does exist! I have been praying to the flying spaghetti monster God, Mio Dio for years to take care of pasta-brained, IL Duce, Signore Scalia. At last!

Hopefully, Obama can push through his nominee before the elections or by inauguration date.

This makes it that much more important for us democrats to win this election !

Because of the Republican- led Senate, we will get a relatively conservative Court, but it won't be as conservative as it has been with Scalia on it. At least it won't be as conservative on social issues.

And if Obama and the Senate cannot come to terms and agree on a Scalia replacement, then the November election will be one of the most hotly contested in history.

There is a God. And I would not want to be Scalia facing St. Peter at the Pearly Gate.

Most Americans do not know the half of what that man did to our country. Not the half. Scalia at the Pearly Gate. What awaits him?

…..who was at that "private party", at an extensive resort, in Texas. I'd like to know who our various Supreme Court Justices hang out with socially. Wonder how many of the guests love Citizen's United, for example.

NPR is opining that it will not open anything for Obama because of where we are in the election cycle. If Obama can not nominate a new judge, it means the next President will get 2 to 3 new appointments. Because several others on the bench are so old at this point.

With Bernie we could get a real FDR style court and overturn Citizen's United.

For two reasons. One he has a better chance of winning against the Republicons.

And two, should Clinton win, she will have no trouble getting confirmations by her friends across the aisle. Of course they won't be progressive.

I met the little shit once. He was at the bookstore where I worked when I was in school, browsing in the Religion section.

True to form, he seemed to be inspecting more than browsing, rather like a medieval inquisitor might.

In fact, smart people who are also evil are especially dangerous. That was the problem with Scalia: He was a very smart but very bad guy. It is not necessarily praising him to call him brilliant because that's a good quality only if it's used for good results.

we should honor his memory by electing Dem majorities to congress immediately to support the president's nominee. Yes, the congresspeople will take office before Obama leaves office.

It's the best way we can remember such an influential justice.

Bernie/Hillary can't do it alone.

Scalia wrote or made some statements recently that indicated he might be slipping mentally. His appointment to the SC was one of the sorriest mistakes GHW Bush made.

...to make sure I had heard about this. She reminded me about an experience she and my dad had with Mr. Scalia. They were waiting in line at a Disney attraction, and Scalia strutted to the front of the line and pulled one of those "Don't you know who I am?" moves. My life-long Republican dad was not impressed.

Please make sure we appoint someone fairly young and healthy, so she or he can be there a long time.

And really what is Clarence Thomas to do? He can't just vote as Scalia votes anymore.

And the right are such hypocrites, if the shoe were on the other foot they would be shrieking about an up or down vote.

I feel bad the creep died but what an opportunity at a critical time....the bell tolls for thee Citizens United.
