Ted Cruz: The "Next President" Should Replace Scalia, Not This One.

That was speedy. Sen. Ted Cruz pipes up, and doesn't think the sitting president should be appointing anyone at all to the Supreme Court to replace Antonin Scalia.

To be clear, there's no constitutional provision that supposes a current president with a year left in his term of office should simply not appoint anyone for that year, leaving the Supreme Court with 8 justices until some other president takes the oath of office. The Constitution is clear; Obama gets to name the next justice of the Supreme Court.

The coroner's report is going to be interesting, though: "Subject appears to have been born with no heart and no brain. We never heard of anyone living to the age of 79 in that condition, but there's a first time for everything."

No, President Obama should be the one to pick the next Supreme Court Justice. There is still almost a full year left in President Obama's term.

This is proof that Republican do not give a damn about the Constitution. They only claim to care about the Constitution when they think they can use it to get what they want. When they cannot get what they want they have no problem scraping the Constitution.

Putting aside the constitutionality of whether a sitting President can *be* on the Supreme Court... why do I picture Barack Obama on the Supreme Court? He's qualified for the job.

Now if Senator Cruz is saying that the next President should also take up a seat on the Supreme Court to replace Scalia...

Or would he say: The Constitution demands that the president makes a nomination and the Senate has a duty to give that person a swift confirmation hearing.
