Nebraska Supreme Court strikes down man's triple-homicide convictions; Kleine will refile charges

LINCOLN — The Nebraska Supreme Court has ordered a new trial for a man convicted of a 2012 triple homicide in Omaha, saying the trial judge failed to block inadmissible testimony.

Friday’s unanimous court opinion gives Timothy “Mont” Britt a chance to win his release from three life prison sentences. Britt, 28, has always maintained he is innocent of the shooting deaths of a reputed drug dealer and his two teenage sons, said Glenn Shapiro, the Omaha lawyer who represented him at trial and on appeal.

“Obviously for Mr. Britt we’re thrilled,” Shapiro said. “We think it’s the right decision.”

Douglas County Attorney Don Kleine said this morning he will refile charges and prosecute Britt a second time.

but I am so tired of Prosecutors. The prosecutor in the original trial knew that the testimony he wanted to use was inadmissible, he shouldn't have tried to get it through a Judge who lacked the ability to discern the law. The original prosecutor was complicit in the error(s) of the Judge.

The prosecutor in this case, should not get a second bite at the apple.
