House GOP wins Obamacare

A federal judge on Thursday ruled the Obama administration has been improperly funding an Obamacare subsidy program, a huge win for the House of Representatives’ lawsuit against the White House.

The judge said that the program can continue, pending appeal. The ruling, if it stands, could be a significant financial setback for the millions of low-income Americans who benefit from the cost-sharing subsidies, which help people pay for out-of-pocket costs like co-pays at the doctor’s office. But it would not be a fatal blow to the future of the president’s signature domestic policy achievement.

Congress authorized the program but never actually provided the money for it, wrote U.S. District Court Judge Rosemary M. Collyer, a George W. Bush appointee.

"Congress is the only source for such an appropriation, and no public money can be spent without one,” she wrote.

And people still claim there's no difference between the parties.

The executive branch executed the order using the related authorized source for subsidizing low income premiums in lieu of the simple Congressional fix.

The beef is with Congress.

And who's left dangling in the wind again? The low-income-poor beneficiaries of the program!

The government's claim (that you echo) that the two types of subsidy are related because they both deal with the same group of people - and therefore don't need to be separately funded - is not particularly persuasive.

Chances are better with an appeal of the standing issue. The ruling itself appears pretty solid.

pending appeal." IMO this is the most important sentence in the OP. This case is unlikely to get on the USSC docket until next year at the earliest, IMO.

Unless Bernie Bots throw the WH and Congress to the Rs by continuing to reinforce Trump's lies, this issue is likely to become moot.
