Scandalous proposal to increase jail terms for women accused of abortion in El Salvador

A new proposal by a group of parliamentarians from opposition party ARENA in El Salvador to increase jail terms for women accused of having an abortion to up to 50 years is scandalous, irresponsible and flies on the face of basic human rights standards, Amnesty International said.

“Parliamentarians in El Salvador are playing a very dangerous game with the lives of millions of women. Banning life-saving abortions in all circumstances is atrocious but seeking to raise jail terms for women who seek an abortion or those who provide support is simply despicable,” said Erika Guevara-Rosas, Americas Director at Amnesty International.

“Instead of continuing to criminalize women, authorities in El Salvador must repeal the outdated anti-abortion law once and for all.”

Following a change in the Penal Code in 1998, abortion in El Salvador has been banned in all circumstances – even when the pregnancy is the result of rape, incest or when the life of the woman is at risk. The current jail term in the Penal Code is from 2 to 8 years. The change in the law has led to wrongful prosecutions and misapplication of criminal law where women are immediately assumed guilty. Women with few economic resources are particularly affected by the ban.

ARENA was founded in 1980 and was composed of former members from PCN. The party arose in response to "the insurgency of the Farabundo Martí National Liberation Front, FMLN, a group that united peasant farmers, unionists and intellectuals, which tried, through arms, to overthrow the dictatorship and to install a state regime inspired by the governments of revolutionary Cuba and Sandinista Nicaragua".

The ideology the party affirms to believe in is a system of democratic and representative government, emphasizing individual rights, the family as the nucleus of society and the respect for private property.

In February 2007, three ARENA politicians were murdered in Guatemala, including Eduardo D'Aubuisson, the son of party founder Roberto D'Aubuisson, in what was considered by the police as a crime related to drugs.

Maria Teresa Rivera didn't realize she was pregnant in 2011 when she went into early labor. The 28-year-old factory worker in El Salvador, who already had one son, started bleeding heavily late one night, so her family called an ambulance to drive her to the hospital. The next day, Rivera was taken to jail. Her crime? Having a miscarriage.

Rivera is one of a number of women in El Salvador incarcerated not for abortion, which is illegal, but as a result of miscarriages. An abortion rights group in the area has identified 17 people convicted of homicide, with sentences upward of 40 years, after facing obstetric emergencies such as miscarriage or stillbirth.

After serving four of her 40-year prison sentence for aggravated homicide, Rivera's conviction was overturned by a judge and she walked free this spring. But the prosecution appealed her release, and this week a three-judge panel will decide whether to hold a new hearing or throw out the charges for good.

Only six countries in the world, including El Salvador, ban abortion in all cases, even when the pregnancy is the result of rape or threatens the life of the mother. Nicaragua, Chile, the Dominican Republic, the Vatican city-state, and Malta are the only other places with similar prohibitions. In January, El Salvador's deputy health minister told women to avoid getting pregnant for two years because of worries over the effects of Zika virus.

does it seem that every time powerful cadres of **males want to impose shit in a way that tries to legitimize their idea(s) - via government laws, rules or what have you - they always start with fucking around with women?


It's the beginning of a slow creep and headed for the groups they hate the most. If they can gets laws on the books against women then they get a hard-on for doing it to other groups. It's a grooming process.

I'm absolutely infuriated with the shit humans are doing to one another and this just piles right on top of that heap.
