Phyllis Schlafly loses trademark dispute with nephew's craft brewery

Source: STL Post Dispatch

“In connection with its usage as a surname, it has the connotation of conservative values, which to millions of Americans (such as Baptists and Mormons) means abstinence from alcohol,” Phyllis Schlafly’s filing with the trademark office stated, adding that “an average consumer in Saint Louis and elsewhere would think ‘Schlafly’ is a surname associated with me.”

In addition to Phyllis Schlafly’s opposition, her son Dr. Bruce Schlafly also filed an opposition to the brewery’s trademark registration, alleging that trademarking the Schlafly name could negatively impact the orthopedic surgeon’s reputation by associating his name with alcohol.

But in its decision, dated Aug. 2, a trademark office board dismissed Phyllis Schlafly’s and Dr. Bruce Schlafly’s opposition filings, which were consolidated.

The board, noting that the law allows a trademark to be registered if it has acquired distinctiveness, rejected the argument that a trademark shouldn’t be allowed because it’s primarily a surname.

Mind you if it was branded Schafly's Old Fashioned Panty Remover, she might have a point

But then who would be able to drink something with a name like that

Instead of just being associated with right wing assholes, Schlafly will also be associated with what is apparently a pretty decent craft beer.

but she sounds awful. It's like someone saying they want to stop "Nixon" from being trademarked because it's too associated with the president.

I know the name from her son Andy, and his stupid 'Conservapedia' project. Which is so bad that it could have been a parody of all that's wrong with conservative (lack of) thinking. It was only his involvement, and someone explaining to me his family's history of batshit-crazy conservatism, that persuaded me that they meant the website to be serious. As an example of how bad its reputation is, it's the website for which I most often see anti-virus warnings like "this site has a bad reputation" in search results.

This looks like another 'closing of the conservative mind'. They think they have a reputation to protect, but in the wider world, association with an honest brewery would do something to rehabilitate the family.

ever encountered a bottle of beer with the name "Schlafly" on the label, Phyllis Schlafly would never spring to mind for me. I probably wouldn't even make the connection.

But now, thanks to her, it will.

So all I can say is lighten up, Phyllis - this Bud's......no, strike that......this Schlafly's for you.

She spewed hatred for Hillary RODHAM Clinton for using her maiden name as her middle name, for Clinton daring to work outside the home, and for not being a "traditional American" mother and wife. Of course, Phyllis was working outside the home and letting other people raise her children while she toured the country, getting paid to speak to wingnut gatherings.

It doesn't surprise me at all that she would try to control her nephew.
