SALT LAKE CITY, Utah, Aug. 12, 2016 (Gephardt Daily) Federal prosecutors are firing back after attorneys for FLDS leader Lyle Jeffs argued fraud and money-launder charges against their client should be dropped.
The charges are related to alleged abuse of Federal $12 million in Supplemental Nutrition Assistance Program (SNAP, known more commonly as food stamps). Prosecutors say it was awarded to needy members of the Fundamentalist Church of Jesus Christ of Latter Day Saints, but used illegally to benefit its top leaders.

Jeffs and others charged reportedly told members to donate their food stamps or buy food at FLDS stores, then to turn in food purchased to the churchs storehouse.
Jeffs attorneys had argued that sharing food supplies and distributing them communally is a tenet of the FLDS church, so is a freedom of religion issue, which offers them First Amendment protection.

SALT LAKE CITY -- In a new court filing, the U.S. Attorney's Office contends that Fundamentalist LDS Church leaders' claims that food stamps must be consecrated to the polygamous sect "is about selfish profit and not a sincere religious belief."
The U.S. Attorney's Office for Utah filed the motion Thursday, urging a judge to reject defense requests to dismiss the indictment against FLDS Church leader Lyle Jeffs and 10 others accused in the massive food stamp fraud case. The federal government argues that funds were taken from hungry families in the Utah-based church to be given to leaders.
In at least one instance, the shortages in nutritious food led to severe health issues for children," prosecutors wrote.
Defense attorneys have argued a "religious right" to consecrate property to the FLDS Church, including Supplemental Nutritional Assistance Program (SNAP) benefits. Prosecutors contend SNAP purchases were given to the FLDS Bishop's Storehouse, where it was doled out, and leaders like Lyle Jeffs and John Wayman got "special treatment."

(135,425 posts)Who knew that he was a white guy with a rather florid face and miserable expression? That's not at all the picture that Mr. Raygun painted for us....and apparently he had no need for a fur coat or a Caddy, preferring the tractor and the Ford pick up, instead!!!
Examples of the non-food items purchased with SNAP proceeds include paper products, a John Deere tractor, and a 2012 Ford F-350 truck, the response states.
