First on CNN: Justice Department will not defend executive order on travel restrictions

The acting Attorney General Sally Yates has told Justice Department lawyers not to make legal arguments defending President Donald Trump's executive order on immigration and refugees, according to sources familiar with the order.
Yates, an Obama appointee who is serving until Trump attorney general nominee Jeff Sessions is confirmed, does not believe the substance of the order is lawful, according to the sources.
Her order is enforced only until she leaves office.
Currently, there are cases filed in at least five states including Virginia, New York, Massachusetts, Washington and California that are challenging Trump's order.

I am responsible for ensuring that the positions we take in court remain consistent with this institutions solemn obligation to always seek justice and stand for what is right, Ms. Yates wrote in a letter to Justice Department lawyers. At present, I am not convinced that the defense of the executive order is consistent with these responsibilities nor am I convinced that the executive order is lawful.
The decision is largely symbolic Mr. Trumps nominee to be attorney general, Jeff Sessions, is likely to be confirmed soon but it highlights the deep divide at the Justice Department and elsewhere in the government over Mr. Trumps order.
Mr. Trump has the authority to fire Ms. Yates but, as the top Senate-confirmed official at the Justice Department, she is the only one authorized to sign foreign surveillance warrants, an essential function at the department.

Until a new AG is confirmed OR she is fired and her replacement confirmed there will be no FISA warrants AT ALL.
If the Orange Pustule fires her, he strikes another blow for terrorism.

The only positions which can seek a FISA warrant require Senate confirmation.

(53,061 posts)of bipartisan consensus on refugee policy but was in such a rush that he a) couldn't coordinate it with his cabinet and b) wouldn't have people in place to defend it.
It isn't just a case of bad policy it is also a case of not being able to understand decision process and managing a complex bureaucratic community.
Of course Sessions is a racist but think about how he will be a terrible legal counsel for Trump and completely inept in forming defense strategies.
Rolling out any major policy position now is premature. First rule in a minority government is to find some policy that can broaden your base of support not to keep playing to the base.
Is it bad policy? Yes, but it's timing is idiotic.

(49,002 posts)tRump is too stupid to see much of it, and the bit he sees he has been persuaded by the real powers (Bannon & Pence) that it is consistent with how he campaigned. Unfortunately, it is consistent on the surface, but even worse in total.
tRump is just enough of a fuck-you robber baron capitalist to want to tear down a lot of government to get it out of his way.
Even tRump is getting madder (crazier) from power. He said all kinds of stuff on the campaign trail and now he realizes there are ways he did not imagine that he can be destructive and so it is going to his head.
End game for Bannon is martial law and white supremacy. He wants to fuck Jews and brown skinned people.
