I wonder if they'll delay the appeal until after they get the 5-4 majority again. If it were heard now, little chance it would be better than 4-4 tie.

Edit: I'm assuming the 9th Circuit will uphold the ban, otherwise those of us opposed to it are in trouble.

they have to appeal. It maybe quite a short amount of time (days) since this is an emergency order.

That said, even if they don't appeal, this decision is whether or not the ban will be in place while the TRO is heard "on the merits". So even if they don't appeal, they still can fight it out at (and up from) the district court.

Permanent Injunction either next week or two weeks hence. Trump is challenging the TRO right now, but his Dept. of Justice will also be able to fight the PI (including various appeals).
