Confederate T-shirt will not be allowed in Tensing retrial

The judge in the murder retrial of a white Ohio police officer who fatally shot an unarmed black motorist ruled that the Confederate flag T-shirt Ray Tensing was wearing would not be admissible in his retrial.
His attorneys moved to to block from the trial a T-shirt depicting a Confederate battle flag that Tensing wore under his uniform, saying it was irrelevant but could be inflammatory.
Judge Leslie Ghiz said that the shirt would prejudice the jury, and noted that she would say the same thing if the T-shirt spoke about God or religion.

(39,405 posts)he should, by all means be allowed to, and the jury should get a good look at it (unless he got an all-white conservative jury).
In a case like this that's like saying "Please convict me."
More seriously, it shows his racial animus AND extremely poor judgment, which the jury needs to know about.

The people of the Confederacy betrayed the US, ditched their loyalty and patriotism, and declared war upon it.
That means, this flag is a symbol of being against the US, right? They not only left their old country, they even declared war on it. They even fired the first shot.
I don't see anyone celebrating Benedict Arnold for his victory in the war against Canada (thanks, harkavagrant.com), so why would any patriot want to associate with these traitors???

(8,700 posts)That I doubt would be upheld on appeal. The owning and wearing of such a shirt goes to the state of mind of the LEO. It's connected and pertinent.
