4 sanctuary cities facing loss of crime-fighting assistance

WASHINGTON (AP) — Attorney General Jeff Sessions moved Thursday to again punish so-called sanctuary cities, this time threatening to deny federal crime-fighting resources to four cities beset by violence if they don’t step up efforts to help detain and deport people living in the country illegally.

The Justice Department sent letters to cities struggling with gun violence, telling them they will be ineligible for a new program that aims to root out drug trafficking and gang crime unless they give federal immigration authorities access to jails and provide advance notice before releasing someone in custody who is wanted on immigration violations. The cities — Baltimore, Albuquerque, New Mexico, and Stockton and San Bernardino in California — all expressed interest in the Justice Department’s new Public Safety Partnership, which enlists federal agents, analysts and technology to help communities find solutions to crime.

In the letters, the department asked the four prospective cities’ police departments to show proof of their compliance by Aug. 18.

The threat marks Sessions’ latest effort to force local authorities to cooperate with federal immigration authorities, part of a push to reduce crime he believes is linked to illegal immigration. Sessions has pledged to make fighting street crime the Justice Department’s top priority, but the strategy is putting him at odds with some city leaders, who say the best way to fight crime and build community trust is to keep local police out of federal immigration matters.

and while Albuquerque is the biggest city (which is why Sessions has heard of it), it isn't the only sanctuary city in this state.

That malevolent little elf needs to have his ears slapped completely off.

In the ACA case SCOTUS held that Medicaid funds couldn't be withheld from non expansion states.

whereas this concerns restrictions associated with "a new program". Courts have given wide latitude to
the Federal Government in regards to the "carrot" aspect of federal funding. For example the 55 MPH
speed limit became national by the Federal Government restricting highway funds to states that enforced
such a limit.

the fake prez to fire Mueller would get passed quickly. That way he can fire Sessions and that is a good thing for the entire country.

Those are notoriously politics-driven. You apply, get evaluated, and get the money or not. Then, unless the evaluation criteria are very explicit, it's not a case of "withholding what's due" but "not getting what the PTB don't want you to get."

Look at how Arnie Duncan played with education grants. It was very political, very much "do what I want, I know better than you what's happening in your state--my notes from the oray summary of the precis of the report are sitting around here somewhere."

The response was very much, "Hey, you don't deserve it" to those who didn't get the grants even before they appointed the committee to write the grant application.

The federal government is given jurisdiction over what is considered "interstate commerce" (which essentially means, any activity that crosses a state or international border). The Executive Branch can't unilaterally rewrite the Constitution to require that a state must carry out federal enforcement activities in order to partner with the feds on general assistance with overlapping subject matter programs. The argument that these cities have made is that if these criminals were wanted on federal immigration charges, they need a federal warrant to be transferred to federal custody, otherwise if they try to follow-through with this demand, a savvy lawyer will have the state/local LEO's extrajudicial detention thrown out.

In addition, the program supposedly has optional "grants", however the bulk of program, which was a follow-on to the Obama administration's Violence Reduction Network initiative, was supposed to be for sharing intel, tools, and techniques.
