Warren Blocks Trump's Pick for Antitrust Chief

Democratic Senator Elizabeth Warren put a "hold" on the confirmation of Makan Delrahim, President Donald Trump’s nominee to run the Justice Department’s antitrust division, delaying a vote until at least September, according to two people familiar with the matter.

Warren has expressed concern about concentration in some markets and the need for vigorous antitrust enforcement to reduce imbalances in the economy. She has described the nomination of Delrahim, a former lobbyist for Anthem Inc., as an indication that Trump’s administration will "put the interests of giant corporations ahead of the American people," according to an April 3 post on her Facebook page.

The two people who discussed the hold spoke on condition of anonymity. A spokeswoman for Warren declined to comment, and Delrahim declined to comment.

Delrahim’s name had been expected to be included in a package of confirmations that cleared the Senate Thursday. Warren’s hold meant his nomination couldn’t be advanced on the Senate floor.

The GOP did "holds" continually when in the minority (and when in the majority with our last Democratic President). See Tom Coburn, the master of the hold.

The system was supposed to be more transparent. In 2007, the Senate began requiring senators to place notices in the Congressional Record within six days of declaring their intentions to place holds. Sloan's group found in December, however, that the new rules have been "disregarded by senators of both parties."

One end run is the practice of merely threatening a hold, rather than placing it. That has the same effect as placing a hold, but it doesn't trigger the formal process that requires disclosure.

Then there's the "tag team" hold, in which senators block someone for a few days, then hand off the hold to another senator, skirting the rule requiring timely disclosure.

At least three Republican senators reportedly used that tactic last year to delay the nomination of Harvard Law School professor Cass Sunstein as the White House's regulatory czar.
