Florida Gov. Rick Scott (R)s office said Friday that the frantic calls for help from a nursing home where 11 elderly patients died have been deleted from the governors cell phone and cannot be used as evidence in the criminal probe of the deaths.
CBS Miami reported that when they contacted Scotts office to obtain the voice mails, spokeswoman said, The voicemails were not retained.
Instead, she said, aides to the governor wrote down the information in the messages, then deleted them.
Natasha Anderson a vice president with The Rehabilitation Center at Hollywood Hills, the facility where the patients died said she was provided the governors cell phone number and instructed to call it if there was an emergency.

I guess it would depend on when they were deleted. If it was after the investigation started Governor Scott may have some 'splaining to do! He might also have some prison time to serve.

(111,277 posts)While I find it likely emergency equipment couldn't get through at the time, I also have to wonder why the facility didn't have a backup generator with a drum of fuel.

(7,624 posts)I believe they had generators but not any that with sufficient power to run the building AC. They powered fans and spot coolers instead.

If there's no digital copy of the actual messages, then I guess they have to take Natasha Anderson's word for it.

In Florida, tampering with physical evidence is a criminal offense that carries felony penalties of up to 5 years in prison and a $10,000 fine. Evidence tampering is any alteration, concealment, or destruction of a document or thing to impede an investigation or legal proceeding.

For instance, in the PDF document linked above disaster relief and response records must be kept for 5 years. Electronic records must be kept according to the same standards as paper records and while they will allow paper printouts, retention of the original electronic records is recommended.
Not only are there rigorous requirements for keeping public records, there are strict guidelines for destruction of them.
The Sunshine Law is one of the best things about Florida - but since Jeb Bush began the reign of Republican governors many parts of the law have been ignored.

Rick Scott office Couldn't be bothered by a plea for help by the elderly?
I hope this reflects on his reelection.
Rick Scott made alot of on camera appearances but ignored nursing homes

(19,565 posts)The initial claim by the nursing home that they'd been seeking help is too easy to prove or disrupt for it to be totally bogus.
No matter how many people messed up, it's still heartbreaking what the outcome was.

TALLAHASSEE Gov. Rick Scotts staff might have broken the law when it deleted voicemails left by workers at a Hollywood nursing home where 11 residents died after Hurricane Irma, a South Florida lawmaker says.
Sen. Gary Farmer, D-Fort Lauderdale, who represents the district that includes the Rehabilitation Center at Hollywood Hills where the deaths occurred, says erasing the voicemails could be a violation of state public records laws.
Clearly there is significant content and purpose behind those voicemails, said Farmer, a trial attorney. They go to a matter that is in controversy right now, which is who did what when and why with regard to the emergency situation at this nursing home.
Scott gave his personal cellphone number to nursing homes and assisted living facilities as Irma approached, but the four messages they left the governor werent kept, as first reported by CBS4s Jim DeFede.
