Kentucky judge resigns rather than hear gay people's cases

A Kentucky judge who refused to hear cases involving gay and lesbian parents just announced his resignation. In April, Mitchell Nance, a family court judge in rural Kentucky, issued an order requiring lawyers representing gay and lesbian parents in adoption cases to notify him of their clients sexuality so that he could recuse himself in advance.
In his order, he said that he believes that the best interest of the child can never be promoted by the adoption by a practicing homosexual. He cited a state rule that requires judges to recuse themselves in cases where their prejudice affects their impartiality. Gay and lesbian parents would have to get the county court to hire a special judge to handle their cases.
Nance submitted his order to the state supreme court for approval and it was rejected by the chief justice. Local LGBTQ activists called on him to resign and filed a complaint with the judicial disciplinary panel, and he was charged with violating judicial ethics rules.
In his response to the complaint, Nances lawyer wrote that he thought he was doing the right thing and being fair to everyone by announcing his prejudice. His recusal would have facilitated the impartiality of the judicial system and ensured that all families had a fair opportunity for adoption. His response goes on to state that its his sincerely held religious belief that the divinely created order of nature is that each human being has a male parent and a female parent.

(11,175 posts)If the court had more than one judge, the LGBTQ parents could appear before a judge who would treat them fairly. This guy would get assigned other cases to balance out the workload. He'd still be setting a bad example of bigotry, but there is something to be said for the open admission of bigotry.
My inference from the article is that he was the only family court judge in the county. His recusals, therefore, couldn't be handled by reassigning the cases. Per the article, "Gay and lesbian parents would have to get the county court to hire a special judge to handle their cases." That might mean a judge less familiar with the law governing family court issues. It would certainly mean that some pandering politician would complain that the county taxpayers were being burdened to provide "special rights" to some people. Under those circumstances, his resignation is the best solution.

It's as 'fair' of a compromise to a complex situation as can be reasonably expected ... at least in a Red area.
At the same time I just can't help but laugh at these assholes who try to pretend that 'religious reasons' actually 'justify' their hate and bigotry. Or funnier still ... that they try to convince us they're OBLIGED to be bigots ... LOLOLOLOL.
Fact is, their 'Bible' is filled with horrific violence, revenge-porn, and so much TERRIBLE advice it's pathetic. 99% of which these same people simply ignore on a daily basis because they realize it's friggin' stupid, outdated and just plain wrong ... but somehow they've not figured out that if 99% is crap, pretty decent chance that it's actually ALL CRAP.
I'm talking about things like, I dunno ... that a MAN is justified in killing his wife if she's unfaithful, and in murdering his children if they fail to properly 'respect him' ... or killing his new bride (who was likely to be 11-13 years old at the time their Holy Book was written) if it turned out she's misrepresented herself as a 'virgin' at the time of the wedding.
Even this ridiculous Book of theirs basically puts 'being gay' the same level of 'sin' as 'eating shellfish' and 'wearing clothing of mixed threads' ... and yet they expect us to believe it's just SOOOOOOOOOOOOOOOOOOO FUKCING IMPORTANT to them that people 'not be gay' cause 'The Book'. Why isn't this shitbird recusing himself from hearing cases re: Shellfish Consumers, and people who buy clothing at Ross, I wonder?
What's so friggin' important about the written words of uneducated wandering desert nomads who lived 2000 years ago, people who knew SFA about ANYTHING?
If you think about it, an average 4th grader of today has an almost infinitely greater understanding of the realities of 'life' and 'the Universe' than ANYONE who put a pen to paper in writing the so-called 'Holy Bible'.
If you could put a random fourth grader from 2017 back in Biblical Times he/she'd have ended up celebrated and revered like 1000x more than Jesus, mark my words. Their 'wisdom' would've ASTOUNDED people back then. But we're supposed to believe ... what ... those folks had everything 'figured out'? PFFFFT. They didn't know SHIT back then ... so adhering to their 'opinions' nowadays ... pretty much makes you a moron.

'Religious Freedom'. Frankly ... F everyone who attempts to do so. Go be 'religious' in the privacy of your friggin' HOME, that's what 'homes' ... are for.
BTW ... Jesus? ... He would HATE YOUR ASS, Mitch. You've completely perverted his message, and used it to justify a behavior that He expressed SO MANY TIMES ... that He was opposed to.

We might as well consider it because the right-wing religious fundies never do. I think the hypocrisy here is even more blatant than the way they ignore all the foolishness in Leviticus (shellfish bad, slavery good, etc.).

(11,175 posts)I agree with you that the Old Testament has a higher bullshit proportion than the New Testament. Even as to the Old Testament, I think 99% bullshit is probably too high. After all, Ecclesiastes provided Pete Seeger with the lyrics for "Turn! Turn! Turn!" That alone is worth something.
