Accidentally killing migratory birds not a crime, Trump Administration says

(Reuters) - Energy companies and other businesses that accidentally kill migratory birds will no longer be criminally prosecuted, the Trump administration said Friday in a decision hailed by industry but denounced by environmental groups.

The decision, in a legal memo from the U.S. Department of Interior, reverses a longstanding practice at the agency as well as a last-minute rule released by the outgoing Obama administration. It comes after several appeals courts ruled that the government was interpreting a century-old law aimed at protecting birds too broadly.

”Christmas came early for bird killers,“ said David O‘Neill, chief conservation officer for the National Audubon Society. ”The White House is parting ways with more than 100 years of conservation legacy.”

The administration’s move is the latest of several actions Trump has taken to weaken environmental protections viewed as burdensome to industry, including shrinking the size of two national monuments in Utah and reconsidering protections for the Greater Sage Grouse, a Western bird whose population has dropped precipitously amid threats to its habitat.

If you are a company that regulates you are a loser.

Over the last year my wife has lost half her income as a consultant to drug companies following the FDA.

Republicans suck always. And it’s not always just about money, but they suck always.

That's what this is for. Eliminating responsibility for recklessness and willfully endangering the environment.

to portray themselves as "pro-life", the Republican Party is really a death cult. Instead of the elephant (which many of their members take great pleasure in slaughtering), they should just adopt the Four Horseman of the Apocalypse as their party's national symbol. This would be especially appealing for those evangelical supporters fantasying about the Rapture.

throwing out corporate responsibility and respect for bird migration.

Worse president ever.

Trump knows he's an asshole so he just doesn't care how history regards him.

what is the rationale for making accidental aviacide a crime? Or any other unintentional act?
Billions of birds like chickens and turkeys are slaughtered every year (month?)...why is that so very different?

12. Gueydan Man Pleaded Guilty for Illegal Shooting of Whooping Crane in Federal Court
Sat Dec 23, 2017, 06:29 PM
Dec 2017

Release Date: 07/11/2017

A Gueydan man pleaded guilty on July 7 in Federal Court in Lafayette for migratory bird violations that occurred in Vermilion Parish.

Judge Carol B. Whitehurst of the Western District Court accepted the guilty plea of Lane T. Thibodeaux, 21, for taking a whooping crane for which there is no season, taking migratory game birds out of season, from a moving vehicle and without a Louisiana hunting license, and wanton waste of migratory game birds. Judge Whitehurst sentenced Thibodeaux to serve 45 days in Federal Prison for each of the five convictions to run concurrently and a $2,500 fine. He must pay his fine in full within one year or he will have to serve 45 days in Federal Prison for each of the five convictions to run consecutively.

Louisiana Department of Wildlife and Fisheries (LDWF) enforcement agents began investigating a whooping crane that was found in a field just north of Gueydan off of Zaunbrecher Rd. with a gunshot wound in its left leg on Nov. 4, 2014. The crane was transported to the LSU Veterinary School where it had to be euthanized because of its gunshot injury.

Through the course of the investigation agents were able to ascertain information from confidential informants that told them Thibodeaux was the person that shot the whooping crane. Agents were able to obtain a search warrant for Thibodeaux’s phone and then collect videos and photos showing Thibodeaux shooting migratory game birds from a vehicle off of a public road near the area where the whooping crane was found. The phone also contained information of Thibodeaux being involved in illegal narcotic activity, which was turned over to the Vermilion Parish Narcotics Task Force.

During the investigation agents also learned that Thibodeaux threatened the informants to not give any information to LDWF agents about the whooping crane he shot. Agents arrested Thibodeaux on charges of felony witness intimidation on March 4, 2015 and those charges are still pending at this time.

The Trump administration is just saying what courts have already said.

Many favor wind power as "green energy" source. Well, guess what? Wind turbines kill birds. Lot's of them. And no it can't be prevented. So if you want wind power then birds getting killed is part of it.

have been killed by human energy production. Everything from wind to petroleum to coal to hydroelectric. (and let's not forget humans ourselves, many of which have -directly- or
-indirectly- died from this enterprise, are also animals...)
