Civil rights trial over David A. Clarke post on Facebook begins in Milwaukee

The question of whether David A. Clarke Jr. used the Milwaukee County Sheriff's Office official Facebook page to retaliate against a Milwaukee man who lodged a complaint against the sheriff went to trial Monday.

The civil rights trial in U.S. District Court was expected to last just one day.

Dan Black and Clarke were on the same flight from Dallas to Milwaukee on Jan. 15, 2017. Black saw Clarke wearing Dallas Cowboys gear and asked if he was David Clarke. Clarke said he was, and Black shook his head and walked away to his seat in coach.

When the plane landed in Milwaukee, Black was greeted by six sheriff's deputies who had been directed by Clarke to take Black aside and question him, which two of them did. They then escorted him from the airport.

The issue for the jury to decide is whether Clarke's posts about Black on the Sheriff's Office official Facebook page in the wake of the airport incident amounted to retaliation against Black for filing a complaint about Clarke with the county.

The article basically says hard to prove for Black. drats.
And Milwaukee County still has to pay Clarke's bills for this!!

The trial is expected to last all day Monday. While Black is likely to testify, it's less clear whether Clarke will take the stand.

Black wants a jury to award him a compensation amount that they choose for emotional distress and other damages, as well as attorneys' fees.

Although Clarke is no longer sheriff, the county is paying his legal bills and ultimately will be liable for any damages. Clarke resigned Aug. 31 to join a political action committee that supports President Donald Trump.
