Top Massachusetts court rules against Exxon in climate case

Source: The Hill

BY MIRANDA GREEN - 04/13/18 11:34 AM EDT

The highest court in Massachusetts ruled against Exxon Mobil in the company's bid to block the state's attorney general from obtaining records to investigate whether the oil and gas giant knew about the role fossil fuels played in climate change.

The Massachusetts Supreme Judicial Court ruled Friday morning that the state attorney general had jurisdiction to investigate the climate-related offenses by Exxon, which included probing whether the company violated the state's consumer protection law when it marketed or sold its products. Previously Exxon had sued to stop the probe and lost, leading to an appeal. The court ruled Friday the original decision had been accurate.

"We conclude that there is personal jurisdiction over Exxon with respect to the Attorney General's investigation, and that the judge did not abuse her discretion in denying Exxon's requests to set aside the C.I.D., disqualify the Attorney General, and issue a stay. We affirm the judge's order in its entirety," the court wrote in its ruling.

The Massachusetts office began investigating Exxon following the publication of leaked documents in 2015 that contained internal communications that appeared to show the company knew of the significant role burning fossil fuels played in climate change. Fossil fuels are Exxon's principal product.

A lot more crude went into the water than what they admitted, lots more.

They fudged the ullage soundings, lied through their teeth about it.

I was fishing for yellowfin sole on the other side of the peninsula when it happened and already had a few years of open water oil spill containment/cleanup under my belt at the time.

I almost went to help clean it up but saw right off the bat things were being done to directly interfere with the cleanup effort by the people in charge.

You don't introduce dispersants into an oil spill you are trying to clean up, it coats ANY containment gear or absorbents used.

Which repels the oil AWAY from them, pretty hard to reclaim oil when it stays away from the resources being used to remove it from the environment.

Why do you think they were wiping it off the rocks and beaches a year later?, because dispersants sink oil into the water column, under the rocks and beaches where you have to wait until it re-appears so you can remove it.

They should have set the whole thing on fire and let it burn away, what do you think happens to crude after its refined?.

Exxon, destroying the environment every way it can any time it has the chance.

They still owe my state for the Valdez. It will never be paid, so every time they or BP lose in court, this creaky old woman does a happy dance.
