Isolated and Unnerved, Trump Sees New York Inquiry as Greater Threat Than Mueller

President Trump’s advisers have concluded that a wide-ranging corruption investigation in New York poses a greater and more imminent threat to the president than even the special counsel’s investigation, according to several people close to Mr. Trump.

As his lawyers went to court on Friday to try to block prosecutors from reading files that were seized from his longtime personal lawyer and fixer this week, Mr. Trump found himself increasingly isolated in mounting a response. He continued to struggle to hire a new criminal lawyer, and some of his own aides were reluctant to advise him about a response for fear of being dragged into a criminal investigation themselves.

The raids on Mr. Trump’s lawyer, Michael D. Cohen, came as part of a monthslong federal investigation based in New York, court records show, and were sweeping in their breadth. In addition to searching his home, office and hotel room, F.B.I. agents seized material from Mr. Cohen’s cellphones, tablet, laptop and safe deposit box, according to people briefed on the warrants. Prosecutors revealed in court documents that they had already secretly obtained many of Mr. Cohen’s emails.

Mr. Trump called Mr. Cohen on Friday to “check in,” according to two people briefed on the call. Depending on what else was discussed, the call could be problematic, as lawyers typically advise their clients against discussing investigations.

This has nothing to do with the Mueller probe.

They will only be able to use those things that are related to the original search warrant.

The prosecutors will not even see the material until a third party fbi/prosecutor neutral group screens out all the material that is not directly listed in the search warrant.

Since Mr. Cohen operated out of New York, odds are that some of those bank fraud and wire fraud transactions happened there.

The prosecutors don't get to see what they got.

Because the violation of attorney/client is such a sensitive area all of the material goes to a neutral fbi/prosecutor group that screens out all of the material that is not DIRECTLY related to the search warrant.

Most of the rico type corruption you are referring to is related to the Manafort investigation which is handled by Mueller. This investigation is completely separate arising solely from the Stormy Daniels matters.

Now it is possible in the referral from Mueller to the DOJ there were other things that Mueller included but its unlikely that there is much connection between Cohen and the Russian probe.

it's about a lot more than just illegal campaign contributions, porn stars and hush money. The sweep is unprecedented in scale and scope when it comes to the personal attorney of a sitting President. Much of what's been picked up in this trawler haul has been turned over to New York state authorities, so says the scuttlebutt.

They are still being examined by the 'taint team' to separate anything that is covered by privilege before its turned over to federal prosecutors.

Searches of lawyers' offices are rare but not unheard of, and prosecutors use what is called a separate "taint team" to review the material and exclude any documents that are covered by the attorney-client privilege.

If they find material that does not involve legal advice between a lawyer and a client, or is exempted from attorney-client privilege because it contains evidence of a crime, that material can be turned over to investigators.

If they haven't already. Neither you nor I know exactly what has happened to date. However, federal and state law enforcement and prosecution share pertinent data all the time. That is not unusual by any means.

are for warrants that are served on attorneys where the question of privilege exists.

The only material that will survive is the material that was specifically listed in the search warrant. The only material that can be passed to state authorities are 1) elements that were listed in the search warrant 2) areas that the federal government has decided that it will not pursue, you cannot double bag prosecutions on the same crime simultaneously in two jurisdictions.

While DOJ is in lead on Cohen, what they are showing is a pattern behavior that is the baes both state and federal criminal charges.

That means New York state (and perhaps California) can also indict him, and no presidential pardon can save him from that.

The first was thinking of a presidential run as only a benefit to his bottom line and a way to make a killing in future profits. The second, and even greedier, was when he began thinking that he DESERVED to be POTUS and was entitled to every cent he could squeeze out of the position.

The raid and all of this stuff in the news involves a FEDERAL criminal investigation over the DOJ's SDNY office. Trump can pardon almost any conviction from this investigation. (Some have argued that Trump can't issue a pardon if he' part of the crime. That's just theor and the Supreme Court would have to decide that sort of stuff.)

Now, Cohen may also be under investigation (and probably is) by a state of New York prosecutor. Trump can't pardon these crimes. The feds and the state may be working together to squeeze Cohen into flipping.

BTW, in a tweet on this veryNYT story, former US Attorney for the SDNY Preet Bahara suggests that Cohen will be facing state charges.

If feds and state work together, Cohen can't escape justice through tRump's corrupt use of the pardon. If Cohen cooperates with the feds, they can say, "We'll use our influence with the state to see that ithey go easier. If you take a pardon, we'll do everything we can to see you don't escape punishment. And we'll make sure you testify against everyone else in Federal court because you no longer can cite the fifth."

In any case, Cohen is toast. He testified under oath he wasn't in Prague for that meeting with the Russians. Turns out Mueller has evidence he was at that meeting in Prague. Perjury... Go to Jail. Do not pass Go. Do not collect two hundred dollars.
