Second mistrial in ex-Navy commanders attempted rape trial

A deadlocked jury led to a second mistrial Monday in the case of a former Navy commander charged with the attempted rape of a junior officer in San Diego.

The panel was dismissed after being unable to reach a unanimous decision on three major counts against John M. Neuhart, according to Superior Court spokeswoman Karen Dalton. A previous jury deadlocked last December.

Jurors heard video from Neuhart’s cellphone in which she screams at him to leave and tells him some 90 times to stop trying to have sex with her.

Neuhart testified that the woman consented to going home and having sex with him. He said he recorded part of their encounter in case the woman later alleged rape.

if she is on tape telling him to stop and leave. At least karama got to him when he broke his leg trying to run away from the scene.

Her inebriated consent earlier became totally irrelevant when she said "Stop" the first, second, third, fourth, fifth, sixth, seventh, eighth, ninth, tenth, eleventh, twelfth, thirteenth... eighty-eighth, eighty-ninth, ninetieth time.

Yeah, that this was twice a mistrial is obscene and infuriating.

Yeah, sure, she was screaming at him to leave and "stop trying to have sex with her" but before that she consented so whatever, no backsies.

...

I think the guy is guilty as sin.

However 2 mistrials due to hung juries would seem to indicate a fundamental flaw in the case whether it be in the presented evidence, jury selection or the charges themselves.
