Over Twitter, President Donald Trump on Monday said he has the power to pardon himself, as the investigation into alleged collusion by his presidential campaign with Russian continues. "As has been stated by numerous legal scholars, I have the absolute right to PARDON myself, but why would I do that when I have done nothing wrong? In the meantime, the never ending Witch Hunt, led by 13 very Angry and Conflicted Democrats (& others) continues into the mid-terms," the president tweeted. Trump's lawyer, Rudy Giuliani, said on Sunday that Trump "probably" has that power, though he said the political ramifications of doing so would be "tough."

The Justice Department was right that guidance could be found in the enduring principles that no one can be both the judge and the defendant in the same matter, and that no one is above the law.
The Constitution specifically bars the president from using the pardon power to prevent his own impeachment and removal. It adds that any official removed through impeachment remains fully subject to criminal prosecution. That provision would make no sense if the president could pardon himself.
The pardon provision of the Constitution is there to enable the president to act essentially in the role of a judge of another persons criminal case, and to intervene on behalf of the defendant when the president determines that would be equitable. For example, the president might believe the courts made the wrong decision about someones guilt or about sentencing; President Barack Obama felt this way about excessive sentences for low-level drug offenses. Or the president might be impressed by the defendants subsequent conduct and, using powers far exceeding those of a parole board, might issue a pardon or commutation of sentence.....
President Trump thinks he can do a lot of things just because he is president. He says that the president can act as if he has no conflicts of interest. He says that he can fire the FBI director for any reason he wants (and he admitted to the most outrageous of reasons in interviews and in discussion with the Russian ambassador). In one sense, Trump is right he can do all of these things, although there will be legal repercussions if he does. Using official powers for corrupt purposes such as impeding or obstructing an investigation can constitute a crime.
But there is one thing we know that Trump cannot do without being a first in all of human history. He cannot pardon himself.

I think not. With all their forethought why in heavens name would they empower an executive to pardon he and his partners crimes? How utterly foolish. Their horror at what they (FF) spawned would create a subterranean whirlwind of casket spinning enough to power a sun lasting beyond the universe demise.

(5,914 posts)Is that they were and had been patriotic gentlemen and scholars and assumed that anyone who held office would always be so. They were more suspicious of other corrupt figures who would try to railroad their honorable colleagues into jail under false pretenses.

(18,470 posts)I think that so many of the problems we face as a country today can be traced back to the aftermath of the Civil War. We basically let the south come back in with little more than a show of groveling. We should have been much, much harder on them after the war. We did almost nothing to change southern culture after the Civil War and let their leadership get away with so much. Plus we put a fatal flaw into the 13th Amendment that allowed for legalized slavery as long as it was punishment for a crime. I think it set up the conditions that allowed people like Nixon and Trump to get in by playing to the racial hatred of their constituents.

We are in the midst of a true constitutional crisis here (yes I know we HAVE been, but this is another stark reminder.) This Trump's latest series of tweets demonstrate he is getting more and more unhinged. However he finally leaves the White House, I do not see it happening without bloodshed, provoked by him.

Or... a candidate could steal billions, then use that money to buy his/her way into office. The crime of theft could be pardoned.

What we must know and understand:
An honest and honorable man, needs no Pardon... and it is highly evident by the nature and virtues which led the minds and hearts of the framers of the United States Constitution who clearly understood this fact very well !!! within their works they as a collective of wise and thinking men, would 'NEVER" have conferred such an insidious power in the hands of any elected official and certainly not in the hands of any sitting President to Pardon Himself. That would be akin to establishing a basis for Dictatorship.
Let' not the wiles of evil men contort the systems of this United States, its Constitution and violate the virtures of its own Declaration of Independence.
The mere thought and claim of a President Pardoning himself, Insults and seeks to Usurp the very Declaration of Independence that Established this nation.
Such men who propose such commentary "as if any President can Pardon himself" is an aim to usurp the system and dignity of the Declarations of Independence which was established with firm conviction against any level or acts of Dictatorships, and anyone as being ones who commit such a claim of Absolute Power represents the most vile of Treasonous Acts and Subversive Conduct against America and All that America Stands For, and the penalty of the highest order should be given to them.
