National Archives rebuffs Dems request for Kavanaugh documents

The Democratic push to get documents from Supreme Court nominee Brett Kavanaugh's work in the George W. Bush administration ran into a new roadblock on Friday.

The National Archives, in a letter to Senate Minority Leader Charles Schumer (D-N.Y.), said it will only respond to a request for documents under the Presidential Records Act (PRA) if they come from a committee chairman, who are all Republicans.

The National Archives and Records “remains unable to respond to PRA special access requests from ranking minority members,” wrote Archivist David Ferriero, who was appointed by former President Obama.

The Archives's stance makes it unlikely that documents from Kavanaugh's time as staff secretary will be handed over to lawmakers unless Republicans agree to request them, something they have been unwilling to do so far.

Just to be clear, I think it’s ridiculous that the ranking member of the committee can’t request documents from the Archive, but apparently that’s how counsel for the National Archives interpreted their rules.

The National Archives is a federal agency whose mission is to provide access to government records. They are funded by the taxpayer and they don't work only for the Republican Party and they aren't paid by the GOP.

Did something (or someone) force them to change their previously stated work on getting Kavanaugh's papers out?



NARA is working on an expedited basis to release prioritized records related to Judge Kavanaugh, in accordance with the Presidential Records Act, the Federal Records Act, and the Freedom of Information Act, just as we have done with previous Supreme Court nominees.

The controlling legislation here is the Presidential Records Act. Some items require special approval for release. I'm guessing, as I have no experience with this legislation. Somebody who knows more about this than I do will have to provide the explanation.

The Presidential Records Act (PRA) of 1978, 44 U.S.C. §§ 2201–2207, is an Act of Congress of the United States governing the official records of Presidents and Vice Presidents created or received after January 20, 1981, and mandating the preservation of all presidential records. The PRA changed the legal ownership of the official records of the President from private to public, and established a new statutory structure under which Presidents must manage their records.

the Dem's should make it clear to Kavanaugh that when we're back in control we'll obtain those documents and if there is any adverse or incriminating evidence/information that should have come to light during the confirmation hearings he (Kavanaugh) will be impeached.

And, will likely be confirmed by a Senate that is controlled by a party that is compromised, as well. As you are well aware, these are not normal times.
